AN ORDINANCE VACATING A PORTION OF DAVID ROAD
RIGHT OF WAY LOCATID ADJACENT TO PARCEL NO'S. 13, 14,
15, 16, 17, 18, 19 AND 20 OF AN UNRECORDED SURVEY MADE
BY C. F. BOWERS AND A. J. FRIEMOTH, REGISTERED
SURVEYORS, DATED APRIL, 1953, IN THE CITY OF DUBLIN,
COUNTY OF FRANI~IN, STATE OF OffiO, AND DECLARING AN
EMERGENCY.
WHEREAS, the City Engineer of the City of Dublin has expressed a desire to vacate
a portion of David Road right-of--way;
WHEREAS, Council finds that there is good cause for such vacation of David Road
right-of--way for the purpose of allowing American Electric Power to construct a
substation to provide high quality electric power to the citizens of Dublin; and
WHEREAS, Council further finds that such vacation will not be detrimental to the
general interest of the City of Dublin.
NOW THEREFORE, be it ordained by the Council of the City of Dublin, State of
Ohio, _1z of the elected members concurring:
Section 1. That a portion of David Road right-of--way, located adjacent to parcel nos.
13, 14, 15, 16, 17, 18, 19 and 20 of an unrecorded survey made by C.F. Bowers and
A.7. Friemoth, Registered Surveyors, Dated April, 1953, is hereby vacated to the
adjoining tax parcels according to Ohio Revised Code Chapter 711. The portion of
David Road right-of--way to be vacated is more fully described in the map attached
hereto.
Section 2. That the City Engineer be, and hereby is, directed to cause said vacation
to be recorded at the Office of the Franklin County Recorder.
Section 3. That the Clerk of Council be, and hereby is, directed to notify the Auditor
of Franklin County of the vacation, by forwarding a copy of this Ordinance thereto.
Section 4. That this Ordinance be, and the same hereby is, declared to be an
emergency measure for the preservation of the public peace, health or welfare of the
residents of this City, and therefore this Ordinance shall take effect and be in force
immediately upon its passage.
