AN ORDINANCE TO APPROPRIATE A 0.065 ACRE, MORE OR
LESS, TENIFORARY CONSTRUCTION EASEIVVIII~TT IN PROPERTY
OWNID BY HPTRI CORPORATION, LOCATED ON THE SOUTH
SIDE OF METRO PLACE SOUTH, IN THE CITY OF DUBLIN,
COUNTY OF FRAIVI~LIN, STATE OF OHIO.
WHEREAS, the City of Dublin is preparing to improve Metro Place South and the
Frantz Road intersection; and
WI~REAS, said improvement will require the City of Dublin to obtain a temporary
construction easement in and to the premises described in the attached Exhibit °A"
located in the City of Dublin, Franklin County, Ohio.
NOW, THEREFORE, BE IT ORDAINED by the Council, of the City of Dublin,
State of Ohio, ~ of the elected members concurring that:
Section 1. A temporary construction easement in and to the premises located in the
City of Dublin, Franklin County, State of Ohio, and more fully described in the legal
description attached hereto as Exhibit "A" is hereby appropriated for the public purpose
of improving Metro Place South and the Frantz Road intersection, pursuant to Ohio
Revised Code Chapter 163 and the Constitution of the State of Ohio.
Section 2. Council hereby fixes the value of the interest appropriated at One
Thousand Four Hundred Sixty Two Dollars and 50/100 Cents ($1,462.50) which sum
shall be deposited with the Franklin County Common Pleas Court for the use and
benefit of the owners of the property appropriated as their interests may appear. Upon
such deposit, the City of Dublin shall take possession of and enter upon the property
pursuant to law.
Section 3. Council finds that the appropriation is necessary for the stated purpose,
that the City has been unable to agree with the owners of the property as to appropriate
compensation, and that the City intends to obtain immediate possession of the property.
Section 4. The City Law Director is directed to file a petition for appropriation in
the Franklin County Common Pleas Court, to have a jury impaneled to assess the
compensation to be paid for the real estate herein described above.
Section 5. The funds related thereto have been previously appropriated within the
Pizzuti TIF Fund for the purpose of paying all costs incident to such acquisition.
Section 6. -This ordinance is hereby declared to be an emergency necessary for the
immediate preservation of the public health, safety and welfare. The reason for such
necessity is that the prompt improvement of Metro Place South and the Frantz Road
intersection is necessary to improve traffic circulation and relieve traffic congestion for
the citizens of Dublin. Therefore, this ordinance shall go into immediate effect.

INTERSECTION IMPROVEMENTS
DESCRIPTION OF TEMPORARY CONSTRUCTION EASEMENT FOR
FRANTZ ROAD/METRO PLACE SOUTH
Situate in the State of Ohio, County of Franklin, City of Dublin and being part of Virginia
Military Survey 2419 and being a strip of land, on, over and across the 4.078 acre tract conveyed
to HPTRI Corporation by deed of record in O.R. 31640 A07, records of the Recorder's Office,
Franklin County, Ohio and being more particularly described as follows;
Being a parcel of land lying along the southerly side of the centerline of Metro Place
South, located within the boundary points of Parcel 4T as delineated upon the City of Dublin's
Right-of--Way plan of Frantz Road and Metro Place South prepared by R.D. Zande and
Associates, Inc, in 1998, and being more particularly described as follows;
Beginning at a point on a curve at the intersection of the existing southerly right-of--way
line of Metro Place South (being 60 feet in width) with the corner common to Lot 4 and Reserve
"D" of METROCENTER of record in Plat Book 55, Page 8 and being the northeasterly corner of
said 4.078 acre tract; said point being 30.00 feet right of centerline station 16+65.98;
Thence S 06° 03' 04" E, a distance of 10.11 feet along the common line of said Lot 4 and
Reserve "D", being the easterly line of said 4.078 acre tract, to a point on a curve, being 40.00
feet right of centerline station 16+64.42;
Thence the following five (5) courses and distances across said 4.078 acre tract:

j 06° 57' S0", a chord bearing of S 71° 51' 07" W, a chord distance of 116.61 feet to a

centerline station 14+80.23;
5. Thence S 74° 33' 38" W, a distance of 111.23 feet to a point on a curve on the
southerly right-of--way line of Metro Place South, being 30.00 feet right of centerline
station 13+75.00;
Thence with a curve to the left having a radius of 680.00 feet, a central angle of
09° 16' 34", a chord bearing of N 69° 25' 09" E, a chord distance of 109.97 feet along said
southerly right-of--way line to a point of reverse curve being 30.00 feet right of centerline station
14+80.23;
Thence with a curve to the right having a radius of 970.00 feet a central angle of
10° 38' 32", a chord bearing ofN 70° 06' 08" E, a chord distance of 179.91 feet along said
southerly right-of--way line to the Point of Beginning, containing 0.065 acres, more or less, being
subject to all easements and restrictions of record.

The bearing datum of the afore described parcel is based upon the State Plane Grid
Bearing of N 60° 12' S4" E, from the Ohio Coordinate System, South Zone, NAD83, as
determined by GPS measurements between R.D. Zande and Associates traverse point 1002 and
National Geodetic Survey Station "Frank 73".
