AN ORDINANCE TO APPROPRIATE A FIFTY (50) FOOT WIDE
ACCESS EASIIVIII~TT ACROSS PROPERTY OWNED BY STATE
SAVINGS BANK, LOCATED ON THE SOUTH SIDE OF
VII~AGE PARKWAY AND WEST OF DUBLIN CENTER DRIVE,
IN THE CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE
OF OHIO.
WHEREAS, the City of Dublin is preparing to construct an access drive to the
proposed AEP substation; and
WHEREAS, said improvement will require the City of Dublin to obtain an access
easement in and to the premises described in the attached Exhibit "A" located in the
City of Dublin, Franklin County, Ohio.
NOW, THEREF RE, BE IT ORDAINED by the Council, of the City of Dublin,
State of Ohio, of the elected members concurring that:
Section 1. An access easement in and to the premises located in the City of Dublin,
Franklin County, State of Ohio, and more fully described in the legal description
attached hereto as Exhibit "A" is hereby appropriated for the public purpose of
constructing an access drive to the proposed AEP substation, pursuant to Ohio Revised
Code Chapter 163 and the Constitution of the State of Ohio.
Section 2. Council hereby fixes the value of the interest appropriated at One
Hundred Thousand Dollars and 00/100 Cents ($100,000.00) which sum shall be
deposited with the Franklin County Common Pleas Court for the use and benefit of the
owners of the property appropriated as their interests may appear. Upon such deposit,
the City of Dublin shall take possession of and enter upon the property pursuant to law.
Section 3. Council fords that the appropriation is necessary for the stated purpose,
that the City has been unable to agree with the owners of the property as to appropriate
compensation, and that the City intends to obtain immediate possession of the property.
Section 4. The City Law Director is directed to file a petition for appropriation in
the Franklin County Common Pleas Court, to have a jury impaneled to assess the
compensation to be paid for the real estate herein described above.
Section 5. The funds related thereto have been previously appropriated within the
Capital Improvements Tax Fund for the purpose of paying all costs incident to such
acquisition.
Section 6. This ordinance is hereby declared to be an emergency necessary for the
immediate preservation of the public health, safety and welfare. The reason for such
necessity is that the prompt construction of the access drive to the proposed AEP
substation is necessary to improve traffic circulation and relieve traffic congestion for
the citizens of Dublin. Therefore, this ordinance shall go into immediate effect.

SOUTH OF VILLAGE PARKWAY

STATE SAVINGS BANK PROPERTY
CITY OF DUBLIN, OHIO
Situated in the State of Ohio, County of Franklin, City of Dublin, being a fifty
foot wide strip of land located within that 21,632 acre tract (Reserve "C", Dublin City
Center, Plat Book 69, Pages 18, 19 & 20), as described in a deed to State Savings Bank,
of record in Official Records Volume 33689, Page F08, all references herein being to the
records of the Recorder's Office, Franklin County, Ohio, said strip being more
particularly described as follows:
Beginning FOR REFERENCE at the most northerly corner of said 21.632 acre
tract and in the right-of--way line of Village Parkway (formerly Federated Boulevard;
thence in a southerly direction along said right-of--way line with'the arc of a curve to the
left, having a radius of 395.00 feet, a central angle of 31 ° 55' lb", the chord of which
bears South 18 ° 29' 20" East, a chord distance of 217.23 feet to the TRUE PLACE OF
BEGINNING:
Thence continuing along saidright-of--way line with the arc of a curve to the Left,
having a radius of 395.00 feet, a central angle of 9° 55' 12", the chord of which bears
South 39 ° 24' 34" East, a chord distance of 68.30 feet to a point;
Thence through said 21.632 acre tract the following courses:
1. North 87° 46' SO" West, a distance of 13.74 feet to a point;
2. South 4$ ° 48' 31" West, a distance of 114.07 feet to a point of curvature;
3. With the arc of a curve to the right, having a radius of 125.00 feet, a
central angle of 31 ° 11' 24", the chord of which bears South 64° 24' 13"
West, a chord distance of 67.21 feet to a point in the westerly line of said
21.632 acre tract;
Thence North 4° 30' 00" East, along said westerly line, a distance of 52.86 feet to
a point located 2.55 feet from an angle point in said westerly line;
Thence again through said 21.632 acre tract the following courses:
1. With the arc of anon-tangent curve to the left, having a radius of 75.00
feet, a central angle of 21 ° O1' 29", the chord of which bears North 59 ° 19'
16" East, a chord distance of 27.37 feet to the point of tangency;
Z. North 48 ° 48' 31" East, a distance of 116.25 feet to a point;
3. North 7 ° 10' 46" East, a distance of 13.29 feet to the TRUE PLACE OF
BEGINNING, and containing 8,674 square feet of land.
Bearings herein are based on North 4 ° 30' 00" East for the westerly line of said
21.632 acre tract contiguous with the filly foot wide strip described herein.
