Form No. 30043 r~ Ordinance No._75-97 _________ Passed--------------------- --- --___19 AN ORDINANCE ACCEPTING THE LOWEST AND BEST BID FOR MOSQUITO FORMULA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR PROCUREMENT OF SAID MATERIAL. WHEREAS, after conducting formal advertising and competitive bidding procedures for mosquito formula; and, WHEREAS, Council has determined the bid submitted by Clarke Mosquito Control Products, Inc. for said material constitutes the lowest and best bid, in the total amount of $22,400.00; and, NOW, ~`HEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~_ of the elected members concurring: Section 1• That the bid submitted by Clarke Mosquito Control Products, Inc. for the above referenced material, in the amount of $22,400.00, is hereby accepted. Section 2- That the City Manager is hereby authorized to enter into a contract with Clarke Mosquito Control Products, Inc. for the procurement of said material as specified above and within said bidder's bid proposal on file in the Division of Human Resources and Procurement. Hazding, Director of Human Resources/Procurement ~" Attached for your consideration please find Ordinance No. 75-97 accepting the lowest and best bid for mosquito formula. Also, attached for your review is a copy of the bid tabulation. Bids were requested based upon an estimated quantity of 800 gallons, which is consistent with the estimated quantity used in 1996. As reflected in the attached bid tabulation, the City received bids from the following suppliers: * Tonaco, Inc. * Clazke Mosquito Control Products, Inc. Although Tonaco, Inc. submitted the lowest bid in the amount of $24.90/gallon, Staff has a number of concerns regarding several aspects of the bid proposal. Firstly, Tonaco failed to complete and to have notarized the Corporate Affidavit, the Property Tax Affidavit and the Non-Collusion Affidavit as required by the bid documents. Secondly, Tonaco has specified a ten (10) day delivery time, compared with a five (5) day delivery as stated by Clazke. In addition, Tonaco submitted a bid for FLAK 2-2, a product that the EPA has no longer approved for manufacture. Furthermore, Tonaco does not have sufficient quantities of existing stock to satisfy the terms and conditions of the bid. The above referenced issues aze such that Staff cannot recommend acceptance of Tonaco's bid as the lowest and best bid. Tonaco's bid is the lowest, but in Staff's judgement, it is not the best. Clarke Mosquito Control Products, Inc. submitted a bid in the amount of $28.00/gallon for mosquito formula. Clazke's bid complies fully with the City's specifications and is therefore responsive to the City's needs. In Staff's judgement, the bid submitted by Clazke Mosquito Control Products, Inc. is the lowest and best bid; therefore, Staff recommends that Clazke's bid be accepted. The term of the Contract, pursuant to the bid documents, would be one yeaz initially with an option to renew for two (2) additional one yeaz periods upon mutual agreement of both parties. Attachments
