AN ORDINANCE AUTHORIZING THE CITY MANAGER
TO ENTER 1NT0 AN AGREEMENT FOR THE LOCATION OF
A WIRELESS TELECOMMUNICATIONS STRUCTURE
WHEREAS, Sprint PCS desires to locate a telecommunications support structure in the
vicinity of Avery Park in order to "build-out" a PCS network; and
WHEREAS, the Telecommunications Act of 1996 requires the reasonable accommodation
of such structures; and
WHEREAS, the City of Dublin has previously employed innovative techniques to
accommodate such structures, while minimizing negative visual and aesthetic impacts; and
WHEREAS, the City of Dublin and Sprint PCS have worked jointly to locate a site and
design an unique support structure which is mutually beneficial to both parties.
NOW, T EREFORE, BE 1T ORDAINED by the Council of the City of Dublin, State of
Ohio, ~ of the elected members concurring that:
RECORD OF ORDINANCES
Section 1. The City Manager is hereby authorized to enter into a lease agreement with Sprint
PCS for the purpose of the placement of a telecommunication support structure at Avery
Park.
Section 2. This Ordinance shall go in to effect on the earliest date permitted by law.

Re: Ordinance 109-97, Sprint PCS Lease Agreement
As you know from presentations previously given by staff, the Telecommunications Act of 1996 has
resulted in a demand for more sites to accommodate wireless telecommunications structures. In
fact, we are receiving more and more inquiries about possible site locations for such structures. As
staff has mentioned in previous presentations and as written in draft wireless telecommunications
legislation (now in circulation among staff for comments), the City should and has been working
proactively with wireless service providers for site locations. Current examples include:
1. Avery Road Water Tower (prior to Telecommunications Act)
2. AEP Tower, Shier Rings Road, multi-use tower
3. Co-location of Ameritech onto an Airtouch Cellular site, Veterinary Clinic, Tuller Road
Each of these are examples of innovative approaches, which serve to minimize the number of
structures and/or minimize negative visual impacts. Staff continues to actively refine draft
legislation prior to submission to Council, is finalizing the Master Wireless Plan, and continues to
use Nexus Telecommunications, Inc. (Jan Murphy) to proactively communicate with wireless
service providers.
As per the attached letter from Sprint PCS, the proposed tower structure will be constructed in

place of an existing light structure at the northern most ballfield in Avery Park. The structure, as
proposed, will be 20 feet higher than the existing 60 foot light structure for a total of 80 feet. The
light set will be re-attached at its existing height. Attached to the Sprint PCS letter are photos of
the cabinets and scaled photo renderings of what the pole with antenna array and light set will look
like. It is important to note that there are currently light structures in the park that are 70 feet in
height. Fencing and landscaping will be provided around the cabinet as described.
'~"" At this time, staff is finalizing the proposed agreement with Sprint PCS. This agreement, with an
executive summary of its key points, will be forwarded to Council prior to the second reading/public
hearing of this legislation.

RE: Proposal to construct a Wireless Telecommunications facility at Avery Road Pazk.
Mr. McDaniel:
My name is Michael Hennon. I represent SprintCom in its' endeavor to construct a PCS network across the
Metropolitan Columbus azea. In our diligence to build-out the system, we actively work with communities, such as
Dublin, during the site selection process. In Dublin, we have engaged the assistance of your Telecommunications
Consultant, Janice Murphy.
Our original seazch placed us at/neaz the Brand Road Fire House. With the assistance of Jan Murphy, we skewed
our design towards the Avery Road Pazk. The pazk has many high mast lighting towers ranging from 60' to 70'
above ground level.
The requirement for our coverage objective, is an 80' structure. Our proposal is to replace an existing 60' baseball
field lighting pole with a telecommunication monopole. The floodlights would be reattached at their current height.
Specifically, we have identified the existing light structure approximately located in right - centerfield of the northern
most baseball diamond. Our proposed lease area is 20' x 15' or 300 squaze feet, located at the base of the structure.
(see attached survey). Access to the site is provided across the existing City of Dublin maintenance road.
At the base of the structure, will be our equipment cabinet. This cabinet does not require a building. The overall
dimensions of the cabinet measure approximately six feet (6') in length, five feet (5') in height, and two and one-half
feet (2'/z') in width. (See photo attachments)
The equipment, and structure will be protected by a chain-link fence. The existing, outfield chain-link fence will
comprise the southern boundary of the lease azea. The remaining three (3) sides will be chain-link fence of identical
height to the existing fence. A dark mesh screening will be applied to the section of fence facing the outfield. The
remaining sides will be landscaped, as deemed appropriate by the City.
A scaled, photo rendering of the completed site has been provided for your examination (see photo attachments).
Based on the information, provided herein, I hope you will perceive our efforts both, to provide PCS coverage, to the
Village of Dublin, and maintain the aesthetic integrity of your community, favorable.
