AN ORDINANCE AMENDING CHAPTER 35 OF THE CODIFIED ORDINANCES
TO REVISE THE FEE AND SERVICE CHARGE REVENUE/COST
COMPARISON SYSTEM AND ESTABLISHING A SCHEDULE OF FEES AND
SERVICE CHARGES FOR CITY OF DUBLIN SERVICES.
WHEREAS, the City of Dublin, Ohio has conducted an extensive analysis of its services, the
full costs of providing those services, the beneficiaries of those services, and the revenues
produced by those paying fees and charges for the services; and,
WHEREAS, based on this extensive analysis, a Cost analysis document, dated June 1997, has
been prepared; and,
WHEREAS, the Finance Committee of City Council has held public workshops to review the
Cost analysis document, including percentage of recovery and the specific fees to be charged;
and,
WHEREAS, the specific fees to be charged for City provided services must be adopted by the
City Council.
NOW, HEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, ~ members of the elected officials concurring:
Section 1. Chapter 35 of the Codified Ordinance of Dublin, Ohio is hereby amended to read as
follows:
Chapter 35
FEE AND SERVICE CHARGE REVENUE/COST COMPARISON SYSTEM AND
FEES
Section 35.80 "Full Costs" Defined
For the purpose of this subchapter, the following definition shall apply unless the context clearly
indicates or requires a different meaning. "Full Costs" includes the following elements:
(1) All applicable direct costs including, but not limited to salaries, wages, overtime, employee
fringe benefits, services and supplies, maintenance and operating expenses, contracted services,
special supplies, and any other direct expense incurred.
(2) All applicable indirect costs including, but not restricted to, building maintenance and
operations, equipment maintenance and operations, communications expenses, computer costs,
printing and reproduction, vehicle expenses, insurance, debt service, and like expenses when
distributed on an accounted and documented rational proration system.
(3) Fixed asset recovery expenses, consisting of depreciation of fixed assets, divided by the
approximate life expectancy of the fixed asset.
(4) General overhead, expressed as a percentage, distributing and charging the expenses of the
City Council, including the Clerk of Council, Department of Law, City Manager, Division of
Accounting and Auditing, Information Technology, Economic Development, the Division of
Personnel and Purchasing, and City promotional programs, and all other staff and support
service provided to the entire City organization. Overhead shall be prorated between tax-
financed services and fee-fmanced services on the basis of said percentage so that each tax-
fmanced service and fee-fmanced service shall proportionately defray such overhead costs.
(5) Departmental overhead, expressed as a percentage, distributing and charging the cost of each
department head and his or her supporting expenses as identified in subsections 1, 2, 3, and 6
of this Section.
(6) Debt service costs, including the payment of interest, and trustee fees and administrative
expenses of all applicable bond, certificate, or securities issues or loans of whatever nature or
kind.
(7) The "full costs," in most instances, will be rounded to the nearest ten dollars, with the actual
fee established by the ordinance establishing a schedule of fees and charges for City services.

Section 35 81 Findings and Intent
(a) It is the intent of the City Council to ascertain and recover the specified percentages of full
costs from fees, charges, and regulatory license fees levied in providing the regulation, products,
or services set forth in this Chapter.
(b) The fee and service charge revenue/cost comparison system set forth in this Chapter
provides a mechanism for ensuring that fees adopted by the City for services rendered do not
exceed the reasonable estimated cost for providing the services.
(c) It is the intent of the City Council to achieve a more equitable and fair mix for fmancing
services set forth in this Chapter in order to reduce or eliminate subsidizing these services with
general tax revenue; thereby, allowing those general tax revenues to be used for general services,
including infrastructure maintenance and replacement.
Section 35 82 Deleeation of Authority and Direction to the Citv Manager
(a) The City Manager is hereby delegated the authority and directed to provide documents to the
City Council to implement its policy to adjust fees and charges to recover the percentage of full
costs as established in this Chapter.
(b) The City Manager is hereby delegated authority to issue Orders defming terms, setting out
administrative, fee collection, and fmancial procedures, defmitions, and establishing effective
dates of all fees set by the City Council by Ordinance. All Orders shall be signed by the affected
department head, shall be signed by the Director of Finance certifying the fmancial
requirements of this Chapter have been met, and shall be signed by the City Manager specifying
the effective date of the Order.
(c) "Full Costs" shall be as defined in Section 35.80. In adjusting fees and charges, the City
Manager shall act in an administrative and ministerial capacity and shall consider only the
standards and criteria established by this Chapter and the applicable State laws. All Orders
issued shall comply in all respects with this Chapter, and the schedule of fees and rates as set
by the City Council.
Section 35 83 Schedule of Fees and Service Charges
(a) The City Manager, Director of Finance, and each City department head, under the direction
of the City Manager, shall review annually the fees and service charges listed in Appendix A-
Schedule of Fees and Service Charges, and provide an adjusted fee or charge schedule to the
City Council for its consideration so as to recover the listed percentage of full costs necessary
to provide the listed regulation, product or service as modified by the "notes" following the list
of services. These fees, unless otherwise specified, are for City of Dublin services and are in
addition to any charges made by any other governmental agencies.
(b) The services as listed in this Section shall be as defined in the document entitled "Cost
Control Study for the City of Dublin, Ohio," dated June 1997, as produced by the City of
Dublin.
(c) All fees and charges set pursuant to this Chapter and Section shall take effect as specified
in each Order.
(d) The City Manager may vary the review schedule listed in the Section if, in the judgement of
the City Manager and a directly affected and requesting department head, a gross inequity would
be perpetrated by not revising a fee or charge prior to the next rate review. Any such special
rate review shall be reported to the City Council at its next succeeding meeting where the City
Council may revise the fee or charge by Ordinance.
(e) If fees are not collected at the time that the service is provided, the City has the right to
pursue collection of any of the fees listed in this Ordinance, including certification to the County
Auditor, remittance to a collection service, or any other appropriate pursuit for payment.

Section 35.84 Fee Appeals and Waivers
Irrespective of the percentage of recovery and the "notes" in Section 35.83 -Appendix A, the
City Council reserves the right to waive any fee in order to:
(A) encourage development projects that enhance the City's tax base as outlined
in the City's Economic Development Strategy;
(B) The City Manager may recommend further waivers or fee adjustments, based
on hardship, to be accepted or rejected by City Council at its next regulazly
scheduled meeting.
Section 2. SEVERABILITY
If any portion of this Chapter is found to be unconstitutional or invalid the City Council hereby
declares that it would have enacted the remainder of this Chapter regardless of the absence of
any such invalid part.
Section 3. REPEALER
All Ordinances, the Codi-feed Ordinances of Dublin, Resolutions, City Council Motions, and all
actions of all City Boards and Commissions in conflict here within aze hereby repealed. The
fees and chazges established by this Chapter shall supersede all previously established fees or
chazges for the same regulation, product or service, and all such previous fees and chazges are
hereby repealed on the effective date of the Order of the City Manager.
Section 4. EFFECTIVE DATE
That this Ordinance shall take effect and be in force on the earliest date permitted bylaw.

Please find attached Amended Ordinance #97-97, the annual update to the Ordinance which amends
Chapter 35 of the Codified Ordinances and revises the City's schedule of fees and service charges for
City of Dublin services. Unless otherwise specified by City Council, these fees will become effective
on January 1, 1998.
Follow-Up on Previously Pending Item -Code Enforcement Inspection:
"""' At the time of the first reading of this Ordinance, there was one item pending with regard to Code
Enforcement Inspection (5-086). The Finance Committee recommended a change for code
enforcement inspections. The first inspection/violation notice would be non-chargeable, and
"" subsequent inspections/violation notices would be chargeable at 100% cost recovery. Previously, there
was no charge for code enforcement inspections. At the first reading of Ordinance #97-97, we
informed City Council that Staff was researching legal and implementation issues associated with
establishing a fee.
We have contacted the City Attorney's Office to determine the viability of charging a fee for this
service. We received a legal opinion from them stating that the City may enact a reasonable fee for this
service. As for enforcement, the code does not specifically provide an enforcement mechanism, but
a city may impose a ticket system whereby tickets are issued for violations of the building, zoning,
housing code, and other violations as deemed necessary. Our City Code currently imposes penalties
for situations such as (but not limited to) placing or dropping injurious materials on sidewalks, noxious
or offensive odors, abandoned refrigerators and airtight containers, driving upon sidewalks or street
lawns, condition of premises and waste accumulation, animals or fowl running at large, barking or
howling dogs, and abandoned vehicles on private property.

On July 10, representatives from the Department of Finance, Division of Planning (Code Enforcement
Officer), and Mayor's Court met to discuss issues associated with charging a code enforcement
inspection fee and its effect on compliance. Compliance with the Code is the goal and our discussion
centered around "what is the most effective method to achieve compliance?" As noted above, our City
Code provides penalties for violating the various building, zoning, and housing codes; however,
citations are currently not issued by the City Code Enforcement Officer. Violations are currently
handled through a series of verbal notices, written notices, reinspections, and if there is still non-
compliance, the final phase is to file a complaint through the City's Mayor's Court. From the
perspective of the Mayor's Court and the Division of Planning, the current system is cumbersome and
inmost cases ineffective. Numerous work hours (and legal fees) are spent processing such cases, and
because the process is so lengthy and cumbersome the violation is allowed to persist. The complaint
is usually resolved with a small fine and without the violator appearing in Mayor's Court.
Conclusion For Code Enforcement Inspection:
During the Finance Committee's July 14, 1997 meeting, they concluded that the most effective method
for resolving a code enforcement violation would be to issue a warning for the violation identifying the
time frame in which compliance is required. The warning would inform the responsible party that if
compliance is not achieved a citation will be issued and they will be required to appear in Mayor's
Court (this would necessitate an Ordinance change from the violation currently being classified as a
minor misdemeanor to a fourth degree misdemeanor-please see attached City Code section).
There are several issues that need to be addressed in order to implement this method of code
enforcement, such as issues involving the City's Code Enforcement Officer writing warnings and
citations for code enforcement violations, the updates needed to his job description, and whether he
should be sworn in to duty. The Mayor's Court is also researching implementation issues through the
City Attorney's Office. Once all legal and implementation issues are resolved, separate legislation
will be prepared.
With regard to the Cost of Services Study and Ordinance #97-97, the Finance Committee directed
Staff to amend the Ordinance and note that an alternative method for enforcement is currently being
evaluated. This amendment has been made to the Ordinance.
Implementation of all Fees:
Prior to these fees becoming effective on January 1, 1998, an "Order" document for each fee will be
signed by the responsible Department/Division Head, Director of Finance and the City Manager, and
the Department of Finance will notify City employees of the fee changes via a Dublin Gram. Each
Department/Division Head has been encouraged to provide the necessary information to parties
affected by their Department/Division's fee changes. A general public notice will be made as to the
change in fees in the November/Decemberfssue of Inside Dublin.
