Form No. 30043 Ordinance No~3-98------------ Passed----- - - ---- --- ------ ---- --- ----19- - - An Ordinance Amending The Annual Appropriations Ordinance For The Fiscal Year Ending December 31, 1998 For The Purpose Of Obtaining A Permanent Access Easement Related To The Construction Of The Columbus Southern Power Substation WHEREAS, the City of Dublin (the City) entered into an agreement with Columbus Southern Power (CSP) relating to the acquisition of properties along David Road for the construction of an electric power substation by CSP and the future construction of Village Parkway extension by the City; and WHEREAS, in accordance with the agreement, the City is responsible for obtaining the necessary access road easement to the substation site; and WHEREAS, State Savings Bank has agreed to grant to the City a permanent non- exclusive access easement identified on the attached exhibits; and WHEREAS, it is necessary to amend the annual appropriations measure to provide the authorized funding necessary to acquire the easement. NOW, THEREF~ O~/R/ E, BE IT ORDAINED, by the Council of the City of Dublin, State of Ohio, / of the elected members concurring that: Section 1. There be appropriated from the unappropriated balance in the Capital Improvements Tax Fund the amount of $79,875 to account number 40-03-14-2550 for the purpose of obtaining the necessary access easement related to the construction of CSP's electric power substation. Section 2.Section 11. That this Ordinance shall take effect and be in force in accordance with Section 4.04(a) of the Dublin City Charter. Passed this,.~~ day of , 1998. Revised September 11, 1997 ACCESS EASEMENT STRIP NO. 1 SOUTH OF VILLAGE PARKWAY WEST DUBLIN CENTER DRIVE STATE SAVINGS BANK PROPERTY CITY OF DUBLIN, OHIO Situated in the State of Ohio, County of Franklin, City of Dublin, being a fifty foot wide strip of land located within that 21.632 acre tract (Reserve "C", Dublin City Center, Plat Book 69, Pages 18, 19 & 20), as described in a deed to State Savings Bank, of record in Official Records Volume 33689, Page FOS, all references herein being to the records of the Recorder's Office, Franklin County, Ohio, said strip being more particularly described as follows: Beginning FOR REFERENCE at the most northerly corner of said 21.632 acxe tract and in the right-of--way line of Village Parkway (formerly Fcde_ated Boulevart~; thence in a southerly direction along said right-of--way line with'the arc of a curve to the left, having a radius of 395.00 feet, a central angle of 31 ° SS' 16", the chord of which bears South 18 ° 29' 20" East, a chord distance of 217.23 feet to the TRUE PLACE OF BEGINNING: Thence continuing along saidright-of--way line with the arc of a curve to the left, having a radius of 395.00 feet, a central angle of 9° SS' 12", the chord of which bears South 39° 24' 34" East, a chord distance of 68.30 feet to a point; Thence through said 21.632 acre tract the following courses: 1. North 87° 46' SO" West, a distance of 13.74 feet to a point; 2. South 48 ° 48' 31" West, a distance of 114.07 feet to a point of curvature; 3. With the arc of a curve to the right, having a radius of 125.00 feet, a central angle of 3I ° 11' 24", the chord ofwhich bears South 64° 24' 13" West, a chord distance of 67.21 feet to a point in the westerly line of said 21.632 acre tract; Thence North 4° 30' 00" East, along said westerly line, a distance of 52.86 feet to a point located 2.55 feet from an angle point in said westerly line; Thence again through said 21.632 acre tract the following courses: 1.
