NOW, RE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, of the elected members concurring:
ection 1 • That the following described real estate (see attached map marked Exhibit "A")
situated in the City of Dublin, State of Ohio, is hereby rezoned Planned Commerce
District and shall be subject to regulations and procedures contained in Ordinance No. 21-
70 (Chapter 153 of the Codified Ordinances) the City of Dublin Zoning Code and
amendments thereto.
Section 2. That application, Exhibit "B", including the list of contiguous and affected
property owners, and the recommendations of the Planning and Zoning Commission,
Exhibit "C", are all incorporated into and made an official part of this Ordinance and made
an official part of this Ordinance and said real estate shall be developed and used in
accordance therewith.
Section 3. That this Ordinance shall take effect and be in force from and after the earliest
period allowed by law.

Perimeter Center, Subarea I
The site is approximately five acres located on the north side of
Perimeter Loop Drive and is occupied by the Crown Mercedes
Dealership. On the south side of Perimeter Loop Drive is a reserve
area for the Perimeter Center Development on which a ±6'-0" high
landscape mount and perimeter trees have been located as a
requirement for development of the Perimeter Shopping Center
The applicant's property is a remote parcel relative to other
parcels in the Perimeter development and does not have frontage
along SR 161/33. Perimeter Loop Drive receives very little traffic
flow relative to Perimeter Drive or other roads in the development.
When the project was originally constructed in 1992, the applicant
requested and obtained approval to relocate and reuse the existing
Mercedes sign, but with a maximum of 8'-0" in accordance with the
Perimeter Development Text. Subsequent to that approval and
construction of the facility, the shopping center was developed and
the 6'-0" high landscape mound was installed.
The installation of the mound has severely hampered Crown Mercedes'
ability to adequately identify its site in a manner similar to the
Chrysler dealership and the soon to be constructed Midwestern Auto
Group (MAG) facility. The Chrysler dealership has the advantage
of a taller sign, immediate adjacency to the shopping center, and
the ability of motorists to readily see its business from SR 161,
Avery-Muirfield, and Perimeter Loop. The MAG dealership has
frontage on three road (Perimeter Loop Drive, Venture DRive, and
SR 161/33). It will also have signage which readily identifies
its business.
Crown Mercedes is asking that it have the ability to identify its
business in an equal level of exposure to the public.

Crown Mercedes is requesting approval of the enclosed text
revisions to allow the installation of a 50 square foot, 15'-0"
high, ground sign. The proposed sign shall be constructed of
aluminum with an opaque sign face, internal illumination, and cut-
out letters and logo. The sign background shall be blue with
white/silver letters and logo, similar to the existing sign
assembly.-The proposed sign shall be installed on a new brick base
with soldier course banding to match the existing structure.

Center PCD, the ground sign is consistent with other area signs, and similar to south facing
signage of other automobile dealerships, with five conditions:
1) That the area of the base not exceed the area of the sign face;
2) That this site be limited to izn~ 15-foot high, 50 square foot ground sign and the
text be revised to reflect same;
3) That the street number be incorporated into the sign;
4) That the base of the ground sign be landscaped, subject to staff approval; and
5) That the applicant secure a revised sign permit.
* Victoria Newell agreed with the above conditions.
VOTE: 4-2.

CASE 3: Revised Composite Plan 98-0212 -Crown Mercedes Dealership -6400 Perimeter
Loop Road
APPLICANT: Dwayne Hawkins, Crown Auto Dealerships, 6001 34th Street North, St.
Petersburg, FL 33714; c/o Victoria Newell, Meacham and Apel Architects, 5640
Frantz Road, Dublin, Ohio 43017.
REQUEST: Review and approval of a revised composite plan (rezoning) under Section 153.085
to modify the signage permitted within Subarea I of the Perimeter Center PCD,
Planned Commerce District. The site contains 2.85 acres located on the north side
of Perimeter Loop Road, approximately S00 feet east of Avery-Muirfield Drive.
It currently contains a 14,000 square foot automobile dealership.

BACKGROUND:
The site is zoned PCD, Planned Commerce District as part of Subarea I of Perimeter Center. It
is generally zoned for transitional retail uses, including auto dealerships. The site was originally
-part of Subarea D and zoned for freeway-oriented offices and hotels, and it was rezoned for an
automobile dealership 1993. The development plan of the 14,040 square foot Crown Mercedes
dealership was approved in 1993.
The Perimeter Center development text establishes the criteria for signage within the PCD, and
wall signs are not permitted in most of Perimeter Center, including Subarea I. The development
plan for Crown Mercedes Dealership included a 29 square foot, eight-foot high ground sign,
which is currently in place. This proposal includes the replacement of the existing ground sign
with either a wall sign (up to 70 square feet in area) facing Perimeter Loop Road ~ a 15-foot
high, 50 square foot new ground sign.
This is a composite plan review under Section 153.085 (development text change) and must be
reviewed by both the Planning and Zoning Commission and City Council. The City Council first
reading of this rezoning was on February 17, 1998. The Commission is to make its
recommendation on the proposal and forward the application back to City Council for a public
hearing and a final vote (second reading). Atwo-thirds vote will be necessary to override a
negative recommendation from the Commission. If approved, the rezoning will take effect in 30
days.
CONSIDERATIONS:
• The site is 2.85 acres located on the north side of Perimeter Loop Road, approximately
500 feet east of Avery-Muirfield Drive. The site and all of the surrounding parcels are
zoned PCD, as part of Perimeter Center.
• This site was rezoned from Subarea D (office and hotels) to Subarea I of Perimeter Center
in 1993. It was rezoned specifically for the development of this car dealership. The
Mercedes dealership was originally located in the building to the west which now houses
Chrysler and Plymouth. The development plan for the subject site was approved in 1993.

A second rezoning for an additional 0.98 acres was approved in 1994. This acreage is
now used for parking for the Crown Mercedes dealership.
~~~ Crown Mercedes has access from both Mercedes Drive (private) and Perimeter Loop
Road. This site is also connecter) to the dealership to the west. The dealership building
~,~ is 14,000 square feet and is constructed of brick with aluminum composite panels. There
is a large display window which faces Perimeter Loop Road.
• The dealership currently has a ground sign, consisting of the Mercedes logo on a two-foot
. high brick base. The colors of the sign are blue and silver. The "logo only" sign is
approximately 29 square feet in area and is eight feet high. This sign was approved by the
Board of Zoning Appeals (BZA) in December of 1992. (Please note that the BZA no
longer handles variances within planned districts.) If the development plan fails to meet
the PCD text requirements, the plan must be revised or the text must be amended through
the rezoning process. This ground sign is the only sign on the site, with the exception of
directional signs. Within the current development standards for Subarea I, this site is
permitted one ground sign, with a maximum square footage of 50 and a height of eight
feet. Wall signs are not permitted in this subarea.
• _ The applicant contends the current sign is blocked by the existing mounding located
between Perimeter Loop Road and SR 161, which is part of the required landscaping for
Perimeter Center. A text revision for Subarea I is requested. The changes would permit
either a 15-foot high ground sign, ~ a wall sign of up to 70 square feet in area.
• The the applicant's preferred sign proposal includes a wall sign, with backlit individual
letters, architecturally integrated with the overall building design. The sign would be 65-
square feet in area, located on the south elevation, facing Perimeter Loop Road and SR
161. The sign will be 26 feet high. The Dublin Sign Code limits the height of wall signs
to 15 feet.
• ~ The second alternative is to replace the existing ground sign with a 48 square foot, 15-foot
high rectangular ground sign. Per the Perimeter Center text, signs shall be generally
rectangular with an approximate three-foot to five-foot height to length ratio. The
proposed sign does not meet this requirement. The sign has arsine-foot high brick base.
Additionally, the current text limits the base of the sign so that it is not larger in area than
the sign face itself. In this case, the area of the base exceeds that of the sign face. The
sign consists of two colors, blue and silver. It is internally lit, with an opaque
background. The copy consists of "Mercedes-Benz" and the company logo. Logos are
limited to 20 percent of the sign face area, and this proposal meets that requirement. The
applicant must incorporate the street number into the sign.
• Wall signs are permitted within the Perimeter Center PCD only within Subarea F (retail
center) and for the Land Rover building (Subarea J). The question of appropriate signage
for developments along US 33/SR 161 as been discussed previously in the rezoning and
development plans for the MAG dealership and Gordon Flesch office building. Facing
SR 161, the MAG dealership and the Gordon Flesch building are permitted to have 50
square foot ground signs, both approximately five feet in height. Wall signs for both
buildings were requested but not approved.
• The Chrysler Dealership, to the west of this site, has a 50 square foot, 15-foot high ground
sign, located to the west of the building.

• Section 153.158 of the Code requires that the base of all permanent ground signs be
effectively landscaped with living plant material and maintained in good condition at all
times.
STAFF RECONIlVIENDATION:
Wall signs aze generally not permitted in most sections of Perimeter Center. The use of wall signs
in the outlying subareas of Perimeter Center has been discussed, however, in the MAG and
Gordon Flesch applications wall signs were requested but not approved. Staff believes this case
should be treated similarly. Wall signs are not appropriate for this site.
This site is located immediately east of one auto dealership and within a few hundred feet of a
second auto dealership. Staff believes all three dealerships should be treated similarly. Visible
from the south, the Chrysler dealership has a 50 square foot, 15-foot high ground sign and the
MAG dealership will have a 50 square foot, five-foot high ground sign. Staff feels the Mercedes
dealership should be granted similar rights. Staff recommends approval of the ground sign
alternative. This would make the sign provisions equal among all dealerships, within the PCD
Conditions:
1) That the area of the base not exceed the area of the sign face;
2) That signs in Subarea I be limited to ~ 15-foot high, 50 square foot ground sign and
the text be revised to reflect same;
3) That the street number be incorporated into the sign;
4) That the base of the ground sign be landscaped, subject to staff approval; and
5) That the applicant secure a revised sign permit.
Bases:
1) That the application, as amended above, meets the intent of the Perimeter Center PCD.
2) The ground sign is consistent with other signs approved for the area.
3) The ground sign is similar to the signage, visible from the south, granted to other
automobile dealerships.

Suzanne Wingenfield presented this proposed text revision for signs for an existing auto dealership
located on a 2.58 acre site on the north side of Perimeter Loop Road. It is zoned PCD, Planned
Commerce District, within Subarea I of the Perimeter Center plan, and auto sales are permitted.
The development plan fora 14,000 square foot dealership was approved in 1993. The Perimeter
_ Center text for most subareas, including this one, does not permit wall signs. The Mercedes
.development plan included 29-square foot, eight-foot high ground sign, currently in place.
This proposal is to amend Subarea I text to allow either a wall sign up to 70 square feet in area,
or a 15-foot high, 50 square foot ground sign. The existing ground sign is located at the
Perimeter Loop entrance. Aground sign would be erected in that same location, or a wall sign
would be located on the south elevation of the building. Ms. Wingenfield said the applicant's
preferred sign is the 65 square foot wall sign consisting of backlit lettering. The wall sign would
be approximately 26 feet high. Code limits the height of wall signs to 15 feet.
Mr. Sprague wanted to see a slide of the large Mercedes symbol seen at night inside the building.
None was available. Ms. Clarke said it cannot be seen during the day, only at night.
The sign existed prior to the text and is legally non-conforming. Mr. Sprague asked in which
subarea was the MAG dealership. Ms. Wingenfield said it was in its own subarea. Ms.
Wingenfield said the applicant contends the ground sign is blocked by mounding between
Perimeter Loop Road and SR 161. It is part of the required landscaping for Perimeter Center.
Ms. Wingenfield said the second sign alternative in the text revisions would replace the existing
~"" ground sign with a larger, taller sign. It would be a 48 square foot, 15-foot high blue and silver
monument sign with backlit lettering. The logo would comply with the 20 percent logo area
maximum. Perimeter Center signage is generally required to be rectangular with a 3:5 foot height
to length ratio, and this proposal does not meet that. The ground sign has anine-foot high brick
base. The existing text states that the base of the sign cannot exceed the square footage of the sign
face itself. In this case, the base exceeds the sign face square footage. The street number must
be incorporated into the sign, either on the sign face or the base.
Ms. Wingenfield said wall signs are not permitted in most sections of Perimeter Center. Wall
signs were proposed facing SR 161 for both the MAG dealership and Gordon Flesch. Neither was
approved. Ms. Wingenfield said staff believes this case should be treated similarly. Staff
supports signage that is commensurate with the other two dealerships, to the east and to the west.
The Chrysler dealership has a 50 square foot ground sign that is 15 feet high, and MAG dealership
will have a 50 square foot ground sign, five feet in height along SR 161.
Ms. Wingenfield said staff recommends approval of the ground sign with five conditions:
1) That the area of the base not exceed the area of the sign face;

Mr. Harian asked if the staff report mistakenly stated that the MAG ground sign was 50 square
feet in area and 15 feet high. Ms. Wingenfield said no, the SR 161 ground sign was 5 feet high
_ . ~ and the square footage was 50 square feet. The overall MAG sign package consists of four to five
signs including two 15-foot high pylon signs which are internal to the site.
Mr. Sprague said he could see the existing sign from SR 161 and also from Avery-Muirfield Drive
in his vehicle. The large, very attractive Mercedes symbol inside the building is quite visible at
night from a substantial distance.
Ms. Wingenfield said the Mercedes and Chrysler dealerships are in the same subarea, but the
Chrysler dealership had a variance on their sign.
Mr. Sprague asked if removal of the Mercedes symbol inside the building had been discussed with
the alternative that an increase of the existing sign be permitted. Ms. Wingenfield said no.
Mr. Peplow asked what the difference in the height elevation was between the SR 161 road
surface and the top elevation of the mounding on Perimeter Loop Drive. Ms. Wingenfield said
the mound is six feet high and is not level with SR 161, but the sign was visible from SR 161.
Mr. Harian said the existing mound at MAG seems to be very high. Ms. Wingenfield said it is
not permanent. MAG has unique "finger" display areas along US 33, and does not actually have
a continuous six-foot mound.
Victoria Newell, Meacham and Apel Architects, representing the applicant, agreed with the
ground sign conditions with one exception. They cannot reduce the base so that the top of the sign
is actually larger because it would change the sign proportions. If the sign width is reduced, the
length could be reduced, in order to meet the 50 square foot provision. Assuring that the
Mercedes Benz text is readable in size would be difficult with the horizontal form of the logo.
They prefer to leave the existing sign in place if the ground sign is the approved.
Ms. Newell said the ground sign is blocked from SR 161 except for the eastbound view, and only
two feet of the sign is visible westbound. The view of the logo is cut off in both directions due
to the mounding. The sign is not clearly visible from the west until you exit onto Avery-Muirfield
Drive and look backwards. When the trees are full, there is only an intermittent view between
them. Ground signs that conflict with trees in the area are not the best long-term solution.
Ms. Newell said the proposed wall sign was backlit, and only a shadow of the letters glow at
night. She passed a sample of the opaque lettering to the Commissioners.

Mr. Sprague said the large Mercedes symbol inside the building posed a problem to him.
Ms. Newell said initially they expected better identification for the existing 100 percent logo sign,
but they have identification problems. People cannot find the dealership with the existing signage.
The Chrysler dealership is seen first on Perimeter Loop. Mercedes is concerned that the future
MAG ground sign will be clearly visible from SR 161.
Mr. Sprague asked if the MAG ground sign was a 15-foot pillar sign. Mr. Lecklider said the one
on SR 161 was 5 feet in height, 50 square feet in area.
Ms. Newell said if Crown Mercedes were permitted a ground sign, it could be located in the same
proximity as would the MAG dealership, and the additional height would not be needed. She said
it was difficult to design signage that will work well.
Mr. Fishman said the ground sign should be equivalent to the Chrysler sign. Dublin is not
required to assure that everybody can see every sign from every angle. He believes that sign
variances beget even bigger, taller signs. He thought the sign should be reasonable. He said the
existing sign could be seen adequately. He believes that the Mercedes dealership is a destination
location. Mr. Fishman opposed a wall sign because it would be out of place.
Ms. Newell understood that large ground signs were not always the best solution and that was why
she had two proposals.
Mr. Fishman said the best solution is to use the existing sign with no variance. Dublin is beautiful
partly because we are very careful with signs and have a great Sign Code. Each variance sets a
"~""' precedent. Mr. Sprague and Mr. Eastep agreed.
Ms. Newell said the problem is with visibility from the east. This business owner has competition
just up the street. She is a Dublin resident and appreciates the sign restrictions in place.
Millard Ripley, the applicant, said the existing sign was alogo-only sign (Mercedes star). The
words "Mercedes Benz" are not displayed anywhere at this dealership. Their logo in proper
proportion with the name "Mercedes Benz" is needed. Even some of their own customers do not
recognize their logo, and many Dublin residents do not know about this dealership.
Ms. Newell was not aware of any signage on Mercedes Drive for the dealership. The front of the
building faces Perimeter Loop Road, and parking faces Mercedes Drive.
Mr. Sprague reminded everyone that there is a reason for different subareas with a particular text
written for each. Every subarea does not need to be identical. Considering this site, its sign
limits, and the signage MAG was permitted, the proposed ground sign may be appropriate.
Mr. Peplow did not want a wall sign at this site but could support the ground sign as proposed.
Mr. Harian and Mr. Peplow supported the ground sign.

Mr. Eastep said this was a destination issue, and purchasing a Mercedes is planned ahead of time.
He said the huge illuminated interior sign gave Mercedes an advantage over other dealerships.

identify the logo. He does not want to set a precedent here. Each sign application should be
~ looked at individually, but no apology is due if the sign is not viewed from every angle.
Mr. Lecklider wanted to be consistent with his position on the MAG dealership. He has a
problem with all 15-foot tall pylon signs. They were too high. He agreed there was not a
particular right for a sign to be seen from SR 161. The required Perimeter mounding seemed to
him to be for the very purpose of screening signs and parking. He did not like the MAG sign
package. Mr. Lecklider could support aneight-foot high sign with the words "Mercedes Benz"
that met Code and felt it would be adequate. He predicted a future sign war on SR 161.
Mr. Peplow made a motion to approve this revised composite plan because it meets the intent of
the Perimeter Center PCD and the ground sign is consistent with other area signs and similar to
south facing signage of other automobile dealerships, with five conditions:
1). That the area of the base not exceed the area of the sign face;
2) That this site be limited to one 15-foot high, ~0 square foot ground sign and the text be
revised to reflect same;
3) That the street number be incorporated into the sign;
4) That the base of the ground sign be landscaped, subject to staff approval; and
5) That the applicant secure a revised sign permit.
Mr. Sprague seconded the motion, and the vote was as follows: Mr. Harlan, yes; Mr. Lecklider,

+r.. The Transitional Nature of Subarea I: The area proposed for Subarea I was contemplated to be
general office, corporate headquarters, hotels, etc. It was further contemplated that this site
would form an important part of the entrance impression of not only Perimeter Mall but Dublin
.itself. Because of specific high quality retail use fulfilling this purpose, the original concept for
Perimeter Center was altered to allow creation of Subarea I permitting automobile dealerships
under strict development standards, in addition to the standards set out for Subarea D.
Subarea I will additionally serve as an architectural transition, incorporating elements of the
1~erimeter Mall, while at the same time easing into the higher scale uses of Subarea D, where
common architectural themes are not contemplated.
Interrelationships of Rezoning and Development PIan:
To caseate the new Subarea I, a rezoning was necessary. This rezoning is agreed by the initial end
user of Subarea I (the Mercedes automobile dealership), the City, and the developer of Perimeter
Mall to be specifically conditioned on the development plan presented for the parcel and the
rezoning and development plan are presented concurrently. It is further agreed that a simple
rezoning to a retail use for this parcel would be inappropriate. In effect, the rezoning amounts
to a variance; the development ~lan, the architecture, building materials, and development
standards of the specific rezonin~,and development plan proposal presented are integral parts of
the rezoning. Taking all of these matters together, the particular retail use presented at the time
of the rezoning of Subarea I is appropriate for this site. however, it does not follow that any
off' use d~~ng in any respect fi-om the development plan presented would be appropriate for
the site. It is a condition ofthe rezoning of Subarea I that any future use of Subarea I must meet
the requirements set out in this text.

The following uses shall be permitted within Subarea I:
a) Those uses listed in Section 1159.01 and 1175.01 of the Zoning Code.

The development shall be limited to the highest caliber auto dealership which shall exhibit an
extraordinary visual quality. Construction shall be limited to one building which does not exceed
44,000 square feet in area. Auto display, sales and services shall be permitted and may not include
-a body shop, or storage of damaged vehicles or other activities which-may-detract-from the higher
visual quality intended here. This site will be treated as an~important gateway into Dublin and the
design will reflect both high quality and a coordination with surrounding development.
No automobile bodywork permitted on site. No damaged automobiles stored outdoors on site.
.Automobiles stored outside of buildings and awaiting sale are limited to number of approved
parking spaces,-and may be displayed in single rows only; i.e., automobiles may be displayed nose
to tail or side to side, but not both. Display pad areas outside of parking areas are not included
in foregoing requirement, providing same is finished with concrete, brick pavers or other
permanent material and is located behind building setback line. No outside loudspeakers
permitted. No balloons, banners, flags, blimps or helium air devices or similar devices, maybe

Lighting:
General standards for lighting are contained in the general text. Lighting for automobile
dealerships must comply with the general standards. Further, lighting for automobile dealership
display if of a higher intensity than surrounding parking lot lighting must make a smooth transition
to lower intensity lighting on surrounding uses. Applicants for this type of land use must show
specific fixtures to be used and specifications, and further must provide lighting engineering plan
showing actual intensities of light falling on illuminated areas: and cutoff areas. ~ Higher intensity
display lighting may be used only in association with sales activity, limited to the hours of the
showroom operation. A secondary lower intensity lighting level consistent with the adjacent
parking lot(s) will be used at other times.
If fixtures selected for surrounding uses in Perimeter Center are not suitable for lighting for
automobile dealerships, then similar and visually compatible designs must be used. Fixture finish
and color will be the same as Perimeter Center standard.

Mrs. King expressed concun about the dealerships that pazk their cars over the sidewalks. Is this

Ms. Clarke responded that this is a Code enforcement issue, and violations are sent when they are
noted or reported.
Mr. Strip asked what would be the outcome if this rezoning is not approved by Council.
Ms. Clarke explained that without this additional parking space, the dealer would be unable to offer
the new utility vehicle that Mucedes is now manufacturing.
A brief discussion followed about the appropriateness of an auto dealership as a "gateway' to
Dublin.
John McDonald. President of Crown Motorcar, explained that the new sports utility line offered by
Mucedes Benz wilt be awarded to only 200 dealers out of 360 nationwide. The new line will not
be ready for two years.

Mark Daniels, Meacham & Apel explained that extensive mounding and landscaping will be installed
to scrcen the pazking lot azea.
Mrs. Boring asked about the stormwater plans and whethu the original plans will be modified.
Mr. Daniels responded that stormwatu management drawings have not been prepared to date for
this portion of the pcoperty, but they will comply in all respecu with the City of Dublin standards.

6. Rezoning Application Z93-008 -Perimeter Center -Crown Mercedes Dealership
Mary Newcomb presented this case and slides. The case was informally reviewed by the
Commission on June 10th. The applicant has requested to amend the approved PCD, Planned
Commerce District plan for Subarea D of Perimeter Center. -This will require the rezoning of
2.85 acres located on the north side of Perimeter Road. The site is located east of the existing
Crown Eurocars Dealership. This request is for an expansion of Subarea I to permit a new
Mercedes automobile dealership of approximately 14,000 square feet: It has a 92-space parking
lot along Perimeter Loop Road and parking for an additional 102 cars of new car storage behind
the building. Screening it will be important.
Materials, colors, site lighting, other specifics,~driveway and entrance locations will need to be
submitted for review of the Development Plan later. Stormwater management and utilities for
the.site will need to meet City standards. -The public road system is built. The site is a major
gateway to the community, and elevations will be important. Staff recommends approval of this
rezoning application with the following conditions to be addressed with the Development Plan:
1) That the landscaping, including perimeter screening, meet Code and be coordinated with
adjacent sites and subject to Staff approval;
2) That Mercedes' drive be constructed along the north property line, subject to approval
by the City Engineer;
3) That stormwater management be designed according to the requirements of the City
Engineer;
4) That the building materials, elevations and colors be consistent with the existing
dealership;
5) That site lighting utilize the same, or matching, features as the existing dealership and
conform to the Dublin lighting guidelines; and
6) That the text composite plan and Subarea map for Perimeter_Center be amended to reflect
these changes.
Mr. Fishman asked if this would mean that Perimeter Center would not meet the standards in
the original text. Ms. Clarke responded that a Subarea text amendment was needed to include
the requirements of the original Mercedes Dealership (now occupied by others) plus the new
site. The original text covered 5 acres, and the amendment needs to cover the full 7.85 acres.
Glen Dugger, attorney, 37 West Broad Street, Columbus, said that Mercedes wants to change
only Subarea I to enable them to build the dealership with the same quality levels and standards
as are contained and approved in the dealership to the west.
Bob Apel, architect representing the applicant, said that the goal tonight was to address the
~, zoning aspects of increasing the Subarea I. It is their intent to make it appear to be one
complex. The same brick, banding and aluminum window system will be used with compatible
landscaping. The site plan will be an expansion to the east of the existing facility. The

dealership will occupy the southern two-thirds, and the northern one-third will be vehicle
storage. They intend a low planting island and then screening the entire area with afive-foot
mound with planting on it to substitute for the usual trees in between the cars. The Mercedes
dealership is scaled down, approximately half of the original building. An entrance off
Perimeter hoop will be shared. There are three areas of sloped glass across the front. The
appearance is slightly different, but character remains the same. The mechanicals are screened.
The building is finished on all four sides. Regarding the conditions, he said it would be difficult
to build the road required in the conditions.
Mr. Dugger said almost all of the Staff conditions will be met during the Development Plan.
The construction issue on Mercedes Drive is one simply of timing. They land owner and
developer of Perimeter Center commits that Mercedes ~ Drive will be completed as part of
Perimeter Center later. He asked that this condition be deferred.. He is not avoiding that
obligation.
~Mr. Sutphen asked if he would accept, as a condition of approval, that the developer will be
responsible for that road. Mr. Dugger would like to transfer the obligation of building the road,
from this project to Perimeter Center. This owner is not a developer.
Mr. Dugger said Muirfield Partners owns Perimeter Center. Muirfield Partners was a
partnership between Mr. McKitrick and Planned Communities, but then went back to Mr.
McKitrick. He owns both this property and Perimeter Center to the north. Mr. Dugger
understands the need for the road, just not the necessity of it being built with this project.
Mr. Fishman asked if it could be approved subject to a bond from the owner.
'" Mr. Dugger gave his commitment to the Commission that the road would be built when
Perimeter Center is built. The development plan will be presented next month with the solution
for the timing of the construction of the continuation of Mercedes Drive.
Mr. Sutphen said the existing dealership has inadequate parking for customers.
Mr. Dugger said the problem is that the Jeep/Chrysler/Eagle dealership were put in that building
-with Mercedes because the new one is not ready. When the new building is done, Mercedes
will move into it, and the parking problem should be resolved. Mr. Dugger said they
understand that they are out of compliance in the existing dealership.
Mr. Manus reminded Mr. Dugger that when Subarea I was created, one major concern was the
screening of mechanicals so as to create an appealing view from I-270 entrance and exit ramps.
Ms. Stillwell asked what the actual height of the buildings was. Mr. Dugger responded that the
text states 65 feet. He would be willing to amend the text to 35 feet because the existing
building is 27 feet and the new one is 26 feet.
~°~~ Ms. Clarke stated one of the reasons for interest in the construction of Mercedes Drive has to
do with shielding the parking lot at the rear. A five foot mound does not help .if the road is

constructed higher than anticipated. Staff s concern is with screening the cars from the outside.
She asked if preliminary grades for that road can be established.
Mr. Dugger believes that is relatively easy to do because Mercedes Drive is built to the east line
~°~ of the existing dealership, and the grade at Perimeter Loop Drive is determined. He will work
on "a plan for insuring the construction of Mercedes Drive for the next meeting.

8. Development Plan -Perimeter Center -New 11~Iercedes Dealership
Mary Newcomb presented this Development Plan for construction of a 14,000 square foot
Mercedes-Benz dealership. The site is currently zoned PCD, Planned Commerce District as part
of Subarea D, zoned for freeway oriented offices and hotels..The site is in the process of being
rezoned to PCD as an expansion of Subarea I and a public hearing is scheduled for the
September 20 City Council meeting. Approval af. this plan will be .conditioned upon Council
approval of the rezoning. The 2. $5 acre site. is located immediately west. of .the existing Crown
Eurocars dealership. Mercedes Drive, a private drive, .is being installed from Perimeter Loop
Road to Old Wilcox Road along the north side of the site. New parking is located along the
southeast and north sides of the building. There is a parking lot on the northern portion of the
site for storage of new (no damaged) vehicles. An electrical transformer located on the north
side of the building will have to be screened in accordance with the landscaping code. Rooftop
mechanicals are to be screened with afive-foot high parapet. Staff is concerned that the
screening be effective from the Avery Road interchange which is considerably higher than the
site and serves as a major gateway to the community. The site is adding one new driveway to
Perimeter Loop Road and will share access with the eusting dealership. The landscaping plan
needs to be revised to comply with Code, including interior landscaping and street trees.
Signage proposed for the site includes a 29 square foot ground sign. This sign is currently on
the existing dealership site. It will be relocated to the southwest corner of the new site. The
new dealership is to match the materials used in the construction of the existing dealership. Staff
would like to see a brick and mortar panel to compare the materials proposed with those of the

existing building before any brick is installed on the new building. Since the Staff Report was
written, the applicant has proposed to use reflective glass in three areas along the southern
elevation.
Staff is recommending approval of the development plan with the following twelve conditions:
1)' .That the rezoning is approved by City Council;
2) That the landscaping, including perimeter screening and treatment of the storage lot, meet
. Code and be coordinated with adjacent sites, and subject to Staff approval;
. ~3) ~ _ That. stormwater management be designed according to the requirements of the City
Engineer; .
4) .That matching building materials 'and consistent elevations, and colors be used to
integrate with the existing dealership and subject to Staff approval;
5) That site ~ lighting utilize the same or matching fixtures ~as -the existing ~ dealership, and
conform to the Dublin lighting guidelines;
6) -That text, composite plan and subarea map: for Perimeter:Center be~amended to reflect
these changes;
7) That.Mercedes Drive (private road on the north property line) will need to be constructed
_ in connection with either Perimeter Center or with the property to the east being built;
8) .That -the preliminary grades -for the extension of Mercedes Drive be approved by
Engineering;
9) That any direction signage comply with the sign code;
10) That a program for the installation within one year for the "Avery Road Buffer" be
submitted within 30 days;
11) That all rooftop mechanicals be fully screened; and
12) That a reduced set of 11" x 17" plans be submitted to the Planning Division.
..Mrs. Stillwell asked that Condition #7 be amended .to read that Mercedes Drive be constructed
before a occupancy permit is issued.
Glen Dugger, Smith and Hale, understood from the motion at the August meeting that Mercedes
Drive would be constructed when Perimeter Center. is constructed, or the property to the east
sold: ~ Mrs. Stillwell said that was correct and Mr: Dugger agreed to the condition.
Randy Bowman said preliminary grades on Mercedes Drive had been submitted to the Planning
Division, but he had not reviewed them yet. Mr. Dugger said the construction plans for
Mercedes Drive were completed with plans for Margarita's Restaurant.
Mr. Mike McGee, architect, for Margarita's Restaurant said that Mercedes Drive was being
. installed now. He felt it had already been approved.. Mr. Bowman had not seen any plans for
the road and requested that the plans be submitted immediately or a stop work order might have
to be issued by the City.
Mr. Geese asked Mr. Dugger if Conditions #1-12 were acceptable to him. Mr. Dugger said all
conditions except #3 and 11 were acceptable.

Bob Apel, Meacham and Apel Architects, said the landscaping would be done according to
Code. There are three shades of glass on the existing building and the new building will have
only two, a tinted glass and a mirrored glass only in the triangles on the top of the building.
The brick will be matched as closely as possible to the existing brick.
Mr: bugger said a composite plan had been received amending the text to reflect the lowering
of the building height and a subarea map had also been submitted. Ms. Newcomb confirmed.
Mr, bugger. said he could not meet the thirty day time limit for the Avery Road Buffer Plan.
It would be taken care of in the Preliminary Development Plan for the resubmittal of Perimeter
Mall, to be submitted in 30-45 days.
Ms. -Clarke said Staff's interest in the required screening opposite this -site,--on--the-south side of
Perimeter Loop Road. The thirty day requirement was not .for the installation, but for an
agreeable time table. Mr. bugger agreed to file for Perimeter Mall rezoning in .thirty to sixty
days. He said it would be filed when the Perimeter Mall rezoning plan would be filed or no
later than December 25, 1993.
Mr. bugger said Condition #11 was agreeable to him. Mr. bugger understood that the
.extension of Mercedes Drive was a condition of the Margarita's Restaurant final development
plan approval. Ms. Clarke said it was not true. Mr. bugger said Condition #7 was okay as
amended.
Randy Bowman said the portion of Mercedes Drive yet to be constructed will extend from the
northeast corner of the existing car dealership out to Perimeter Loop Road (Wilcox Road).
~;~ Three sections of Mercedes Drive were being discussed. One is along the north side of this
proposed development. There is a small section and a third section which is along the south side
of Margarita's Restaurant. It was a condition of the final development plan for Margarita's
Restaurant that before an occupancy permit may be granted to it that Mercedes Drive be
constructed along the south side and also the other private access drive along the west side of
Margarita's Restaurant. There is a small link missing. > In-meetings there was a-concern about
this missing link in Mercedes Drive and there is interest by the Commission and Staff that
Mercedes Drive be constructed iri its entirety before.occupancy. of.Margarita's Restaurant be
granted. Mr. Fishman said that it should be done by the time the dealership was completed.
Mr. bugger said Condition #7 was consented to at the last meeting and that the rules were being
changed.
Mrs. Stillwell asked when Mercedes Drive would be a full road. Mr. bugger said it would be
as Condition #7 stated and was agreed to last month.
Mr. Bowman said he had reviewed plans and had found no where Mercedes Drive being
approved east of the eastern terminus. He requested that if work was being done he be
contacted the next day.

meeting. An accelerated time-frame for the completion of Mercedes Drive was the
Commission's concern. Mr. Dugger understood that the agreement between the developer and
Margarita's is to extend the drive entirely from its eastern terminus at the northeast corner of
the existing car dealership to Perimeter Center Loop Road.
'"` Mike McGee said the condition under which the owner signed who purchased the property and
the conditions under which rezoning stated that there were two sections of road that were not
- constructed 'and .had no names (one was called Mercedes) .that are to' be constructed and
.completed in time for the opening before permit of Margarita's. The extension of those one-way
north, south, east or west, not attached to the Margarita's property, is not a zoning condition
nor a condition having to do with the sale.
:Mr. Dugger said Mr.- Hale said this was the-agreement-that it~e extended across -Mr. -Dugger
said if it were not done as part of Margarita's he had no ability to have it done.
Dr. Sherrie Ridenour, owner of Perimeter Veterinary Hospital, said a condition of her building
permit was to have the road connected to.her property. She felt this should be considered.
Mr. -Sutphen made a motion to accept this development plan with the following conditions:
1) That the rezoning is approved by City Council;
2) That the landscaping, including perimeter screening and treatment of the storage lot, meet
Code and be coordinated with adjacent sites, and subject to Staff approval;

In response to Mr. Kranstubs, Ms. Newcomb confirmed that this rezoning will permit an expansion
of the subarea I to allow another auto dealership. Mr. Kranstubs expressed concern about the
poss3te focal Impact of the change from freeway office to an auto dealership in terms of tax
revertua.
Mr, Amorost his concerns with the time previously zpent In working out the varbus typo of land
uses for Perimeter Mill and now permitting changes which could alter the appearance to a suburban
auto mall rather than an office complex.
Mr. Campbell noted chat the legal description accompanying the ordinance contains 2.85 acres and
the ordinance should be amended to reflect this change.
Glen Dogger and Bob Apel addressed. Council regarding the development. Mr. Apd showed
drawings to Council and described the proposed building which will be 15,000 square fat.
Mr. Strip eked for clarification regarding the business operations.
Mr, Apel responded that the original Mercedes building was too large, and.thus they have taken on
a separate Jag-Chrysler Plymouth-Eagle franchLce. They arc two separate franchises, two separate
buildings, with one owner and one piece of ground operating u one dealership.
Mr, Dogger added that if the new building is not approved, the Mercedes dealership will be lost.

Bobbie Clarke presented this rezoning application fora 75-foot strip located on the eastern side
of the new Mercedes dealership. The Perimeter Center PCD, Planned Commerce District,
originally did not permit any auto dealerships. In 1990 it was amended to create Subarea I, five

the building... Mercedes then rezoned two acres adjacent fora smaller facility. The building is
near completion and this an addition to that site. During the construction periai approximately
thirty cars have been parked along Mercedes Drive. When Perimeter center is built and in use,
this space will be needed. Staff assumes this is a temporary situation while the building is under
construction.
Staff is recommending approval with the following three conditions:
1) That the Composite Plan and Development Tezt 'for Perimeter Center be ~ modified to
indicate changes in acreage;
2) That parking along Mercedes Drive be discontinued by the opening of Perimeter Center
or completion of ties lot, whichever comes first;
3) That the landscaping comply with Code and be subject to Staff approval; and
4) That this parcel be combined with the auto dealership parcel which it will serve.
Mark Daniels, the applicant agreed to the above conditions.
The Commission members had no comments.
