AN ORDINANCE AMENDING ORDINANCE NO. 57 -94 PASSED
JUNE 20, 1994, AS SUBSEQUENTLY AMENDED, TO
SUPPLEMENT THE PUBLIC IMPROVEMENTS TO BE MADE TO
BENEFIT THE PARCELS IDENTIFIED IN THAT ORDINANCE.
WHEREAS, pursuant to Ohio Revised Code Sections 5709.40, 5709.42 and 5709.43,
this Council passed Ordinance No. 57 -94 on June 20, 1994 (the "Original 77F
Ordinancdo, and subsequently amended the Original TIF Ordinance by passage of
Ordinance No. 62 -94 on June 27, 1994, Ordinance No. 44 -03 on April 21, 2003 and
Ordinance No. 86 -08 on December 8, 2008 (the Original TIF Ordinance collectively
with such amendments, the "TIF Ordinancd� thereby declaring improvements to
parcels of certain real property located in the City (as described and depicted in the
TIF Ordinance and referred to therein as the Property) to be a public purpose,
exempting those improvements from real property taxation for a period of time,
specifying public infrastructure improvements (as described in the TIF Ordinance and
referred to therein as the Infrastructure Improvements) to be made to benefit those
parcels, providing for the making of service payments in lieu of taxes (the "Service
Paymen&o by the owner(s) thereof, and establishing a municipal public
improvement tax increment equivalent fund into which those Service Payments were
to be deposited; and
WHEREAS, this Council desires to specify additional public infrastructure
improvements that will directly benefit the Property; and
WHEREAS, notice of this amendment to the TIF Ordinance has been timely
delivered to the Dublin City School District and the Tolles Career and Technical
Center in accordance with Ohio Revised Code Sections 5709.40 and 5709.83;
NOW, THE FORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, of the elected members concurring, that:
Section 1 . The public infrastructure improvements set forth in Exhibit B to the
Original TIF Ordinance (as heretofore amended) and to be made or caused to be
made by the City shall also include those public infrastructure improvements
identified on ExHiBiT A attached hereto which the City hereby determines will
directly benefit the Property.
Section 2 . Except as provided herein, all other provisions of the TIF Ordinance
shall remain in full force and effect and the City Manager and Director of Finance are
directed to make such arrangements as are necessary and proper for collection of
the Service Payments. Those City officials are further authorized to provide such
information and to execute, certify or fumish such other documents, and to do all of
the things as are necessary for and incidental to carrying out the provisions of this
Ordinance.
Section 3 . Pursuant to Section 5709.40 of the Ohio Revised Code, the Clerk of
Council is hereby directed to deliver a copy of this Ordinance to the Director of the
Development Services Agency of the State of Ohio within fifteen days after its
passage.
Section 4 . This Council finds and determines that all formal actions of this Council
concerning and relating to the passage of this Ordinance were taken in an open
meeting of this Council and that all deliberations of this Council that resulted in those
formal actions were in meetings open to the public in compliance with the law.

Re: Ordinance 34 -15 - Amending Ordinance 57 -94 passed June 20, 1994, as
subsequently amended, to supplement the public improvements to be
made to benefit the parcels identified in that Ordinance (McKitrick)
Summary
Ordinance No. 34 -15 provides for amendments to the existing legislation that established the
McKitrick TIF district. The McKitrick TIF District was established in 1994 to provide a funding
mechanism for the construction of Emerald Parkway Phase I and Phase II, connecting Dublin Road to
Coffman Road. The construction of the roadway was a critical component of the incentive package
assembled for Cardinal Health Inc. and Verizon, then Cellular One.
In 2003, Council approved modifications to the McKitrick TIF (Ordinance No. 44 -03). The
modifications provided for the implementation of a "non- school TIF" after the terms of the "straight
TIP' expired and addition of Emerald Parkway from Riverside Drive to Sawmill Road to the description
of the Public Improvements. This final phase of Emerald Parkway was constructed in 2014.
In 2008, Council approved modifications, which permitted the public infrastructure improvements to
include (1) the redirection of Post Road to Commerce Parkway; (2) the reconfiguration of the
southbound lanes of Emerald Parkway at Post Road to include two left turn lanes; and (3) the
reconfiguration of the lanes on Post Road to create two eastbound lanes and other related
improvements.
Service payments for Emerald Parkway Phase I converted from a "straight TIP' to a "non- school TIP'
in tax year 2003. The service payments for Emerald Parkway Phase 2 converted to a " "non- school
TIP' in tax year 2010. It will remain a "non - school TIP' until its expiration in 2024.
Staff is currently proposing another amendment to the TIF, which will allow for the public
infrastructure improvements to include the relocation of Riverside Drive, including improvements to
the Riverside Drive/Tuller Road intersection as well as John Shields Parkway /Riverside Drive. This
construction is anticipated to commence in late April /early May 2015.
The required notice has been sent to the Dublin City School District and Tolles Career & Technical
Center.
Copies of Ordinance Nos. 86 -08, 44 -03, 62 -94 and 57 -94 as well as a TIF map are attached for
reference.
Recommendation
Staff recommends that Council adopt Ordinance No. 34 -15 at the second reading /public hearing on
May 18, 2015.
ORDINANCE NO. 57 -94
AN ORDINANCE DECLARING IMPROVEMENTS TO A CERTAIN PARCEL
OF REAL PROPERTY TO BE A PUBLIC PURPOSE, DESCRIBING THE
PUBLIC INFRASTRUCTURE IMPROVEMENTS TO BE MADE TO BENEFIT
THAT PARCEL, REQUIRING THE OWNERS THEREOF TO MAKE
SERVICE PAYMENTS IN LIEU OF TAXES, AND ESTABLISHING A
MUNICIPAL PUBLIC IMPROVEMENT TAX INCREMENT EQUIVALENT
FUND, FOR THE DEPOSIT OF SUCH SERVICE PAYMENTS, AND
DECLARING AN EMERGENCY.
WHEREAS, Ohio Revised Code Sections 5709.40, 5709.42 and 5709.43 provide that this
Council may declare improvements to a parcel of real property located in the City to be a public
purpose, thereby exempting those improvements from real property taxation for a period of time,
specify public infrastructure improvements to be made to benefit that parcel, provide for the
making of service payments in lieu of taxes by the owner thereof, and establish a municipal
public improvement tax increment equivalent fund into which such service payments shall be
deposited; and
WHEREAS, a developer of office buildings (the Developer) intends to acquire certain
real property located in the City, which property is described in Exhibit A hereto (the Property),
and contemplates making improvements to the Property and this Council expects to make the
public infrastructure improvements described in Exhibit B hereto, that once made would benefit
the Property; and
WHEREAS, the City has determined that it is necessary and appropriate and in the best
interests of the City to provide for service payments in lieu of taxes with respect to the Property
pursuant to Section 5709.42 of the Ohio Revised Code; and
WHEREAS, notice of this proposed ordinance has been delivered to the Board of
Education of each affected School District in accordance with Section 5709.40 of the Ohio
Revised Code;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
Franklin, Union and Delaware Counties, Ohio, that:
Section 1. Pursuant to and in accordance with the provisions of Ohio Revised Code
Section 5709.40, this Council hereby finds and determines that 100% of the increase in true
value of the Property subsequent to the effective date of this ordinance (which increase in true
value is hereinafter referred to as the "Improvement" as defined in Section 5709.40) is a public
purpose, and all of said Improvement is hereby declared to be a public purpose for a period of
30 years and exempt from taxation commencing on the date of passage of this ordinance and
ending on the earlier of 30 years from such date or on the date on which the City can no longer
require service payments in lieu of taxes under Sections 5709.40 and 5709.42 of the Revised
Code, all in accordance with the requirements of said Sections 5709.40 and 4709.42.
Section 2. The public infrastructure improvements set forth in Exhibit B hereto and to
be made by the City are hereby designated as those public infrastructure improvements that
Mllefll, or that once made wlii benefit, the Property (the Infrastructure Improvements).
Section 3. As provided in Section 5709.42 of the Revised Code, the owner of the
Improvement is hereby required to, and shall make, service payments in lieu of taxes to the
County Treasurer on or before the final dates for payment of real property taxes, which service
payments shall be deposited in the McKitrick Project Municipal Public Improvement Tax
Increment Equivalent Fund established in Section 4 hereof. The Agreement between the City
and the Developer, in the form presently on file with the Clerk of Council, providing for, among
other things, the payment of such service payments, is hereby approved and authorized with
changes therein not inconsistent with this ordinance and not substantially adverse to this City and
which shall be approved by the City Manager and Director of Finance. The City Manager and
Director of Finance, for and in the name of this City, are hereby authorized to execute that
Agreement, provided further that the approval of changes thereto by those officials, and their
character as not being substantially adverse to the City, shall be evidenced conclusively by their
execution thereof. This Council further hereby authorizes and directs the City Manager, the
Clerk of Council, the Director of Law, the Director of Finance, or other appropriate officers
of the City, to make such arrangements as are necessary and proper for collection from the
owner of said service payments in lieu of taxes.
Section 4. This Council hereby establishes pursuant to and in accordance with the
�` provisions of Section 5709.43 of the Ohio Revised Code, the McKitrick Project Municipal Public
Improvement Tax Increment Equivalent Fund (the Fund), into which shall be deposited all of
the service payments in lieu of taxes distributed to the City with respect to the Improvements
on the Property by or on behalf of the County Treasurer as provided in Section 5709.42 of the
Ohio Revised Code, and hereby provides that all of the moneys deposited in the Fund shall be
used solely for the following purposes:
(i) To pay the cost of constructing the Infrastructure Improvements; and
(ii) To pay the interest on and principal of bonds or notes issued by the City in order
to finance the Infrastructure Improvements until such notes or bonds are paid in full.
The Fund shall remain in existence so long as such service payments are collected and
used for the aforesaid purposes, after which said Fund shall be dissolved in accordance with said
Section 5709.43.
Section 5. Pursuant to Section 5709.40 of the Ohio Revised Code, the Clerk of this
Council is hereby directed to deliver a copy of this ordinance to the Director of the Department
of Development of the State of Ohio within fifteen days after its passage. On or before March
31 of each year that the exemption set forth in Section 1 hereof remains in effect, the Clerk or
other authorized officer of this City shall prepare and submit to the Director of the Department
of Development of the State of Ohio the status report required under Section 5709.40(D) of the
Ohio Revised Code.
Section 6. This Council finds and determines that all formal actions of this Council
concerning and relating to the passage of this ordinance were taken in an open meeting of this
Council and that all deliberations of this Council that resulted in those formal actions were in
meetings open to the public in compliance with the law.
Section 7. This ordinance is declared to be an emergency measure necessary for the
immediate preservation of the public peace, health, safety or welfare of this City and for the
further reason that this ordinance is required to be immediately effective in order to provide for
the funding for the Infrastructure Improvements so that the Infrastructure Improvements may be
constructed as quickly as possible; thereby permitting the Improvement to be constructed as
quickly as possible, providing necessary jobs and employment opportunities and improving the
economic welfare of the people of the City; wherefore, this ordinance shall be in full force and
effect immediately upon its passage.

Public Improvements
The public improvements consist of constructing all or a portion of a new east -west street to
ultimately connect Coffman Road with Dublin Road, with that improvement extending
approximately 3,000 lineal feet east from Coffman Road, from a point south of Dublin Coffman
I1igh School. The public roadway improvements include three -lane pavement, curbs and gutters,
a bridge/culvert crossing over the Indian Run at the eastern end of the street extension, street
lighting, storm sewers, sanitary sewers, water mains, sidewalk and/or bikeways, and landscaping
within the right -of -way. Also included are any necessary improvements to Coffman Road to
connect the new street to existing pavement. In addition, the public improvements include design
and other related costs, any required land acquisition needed for right -of -way, final plat
preparation as required, erosion and sediment control measures, traffic control devices, grading
and other related work, survey work, soil engineering for the public street, construction staking
and all other matters and activities necessary and appurtenant to those public improvements.

AN ORDINANCE AMENDING ORDINANCE NO. 57 -94 PASSED
JUNE 20, 1994 DECLARING IMPROVEMENTS TO A CERTAIN
PARCEL OF REAL PROPERTY A PUBLIC PURPOSE TO ADJUST
THE DESCRIPTION OF THE PUBLIC INFRASTRUCTURE
IMPROVEMENTS TO BE MADE BY THE CITY TO BENEFIT
THAT PARCEL, AND DECLARING AN EMERGENCY.
WHEREAS, pursuant to Ohio Revised Code Sections 5709.40, 5709.42 and 5709.43
this Council by Ordinance No. 57 -94 passed June 20, 1994 (the "TIF Ordinance ") declared
certain improvements to a parcel of real property (the "Property ") located in the City to be a
public purpose thereby exempting those improvements from real property taxation for a period
of time, specified public infrastructure improvements to be made to benefit that parcel, provided
for the making of service payments in lieu of taxes by the owner thereof, and established a
municipal public improvement tax increment equivalent fund into which those service payments
shall be deposited, all as to be further evidenced by a Tax Increment Financing Agreement (the
"Agreement "), to be made and entered into between the City and the owner of the Property (the
"Developer "); and
WHEREAS, this Council desires to adjust the public infrastructure improvements
specified in Exhibit B to the TIF Ordinance, to be made to benefit the Property, to be those
public infrastructure improvements specified in Exhibit B to this proposed Ordinance; and
WHEREAS, notice of this proposed ordinance has been delivered to the Board of
Education of each affected School District in accordance with Section 5709.40 of the Ohio
Revised Code;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
Franklin, Union and Delaware Counties, Ohio, that:
Section 1. This Council hereby confirms the findings and determinations in the TIF
Ordinance, pursuant to and in accordance with the provisions of Ohio Revised Code Section
5709.40, that 100% of the increase in true value of the Property subsequent to the effective date
of the TIF Ordinance (which increase in true value is referred to as the "Improvement" as
defined in Section 5709.40) is a public purpose, and that all of that Improvement is a public
purpose for a period of 30 years and exempt from taxation commencing on the date of passage
of the TIF Ordinance and ending on the earlier of 30 years from such date or on the date on
which the City can no longer require service payments in lieu of taxes under Sections 5709.40
and 5709.42 of the Revised Code, all in accordance with the requirements of said Sections
5709.40 and 5709.42.
Section 2. The public infrastructure improvements set forth in Exhibit B to the TIF
Ordinance and to be made by the City are hereby amended to be those public infrastructure
improvements provided in Exhibit B to this Ordinance, and those public infrastructure
f . improvements specified in attached Exhibit B are designated as public infrastructure

deemed to be the "Infrastructure Improvements" as defined in the TIF Ordinance.
Section 3. Pursuant to Section 5709.40 of the Ohio Revised Code, the Clerk of this
Council is hereby directed to deliver a copy of this ordinance to the Director of the Department
of Development of the State of Ohio within fifteen days after its passage. On or before March
31 of each year that the exemption set forth in Section 1 hereof remains in effect, the Clerk or
other authorized officer of this City shall prepare and submit to the Director of the Department
of Development of the State of Ohio the status report required under Section 5709.40(D) of the
Ohio Revised Code.
Section 4. This Council finds and determines that all formal actions of this Council
concerning and relating to the passage of this ordinance were taken in an open meeting of this
Council and that all deliberations of this Council that resulted in those formal actions were in
meetings open to the public in compliance with the law.
Section 5. This ordinance is declared to be an emergency measure necessary for the
immediate preservation of the public peace, health, safety or welfare of this City and for the
further reason that this ordinance is required to be immediately effective in order to provide for
the funding for the Infrastructure Improvements so that the Infrastructure Improvements may be
constructed as quickly as possible; thereby permitting the Improvement to be constructed as
quickly as possible, providing necessary jobs and employment opportunities and improving the
economic welfare of the people; wherefore, this ordinance shall be in full force and effect
immediately upon its passage.

IMPROVEMENTS TO BE MADE TO BENEFIT THE PARCELS
IDENTIFIED IN THAT ORDINANCE AND PROVIDE FOR
PAYMENT OF A PORTION OF THE SERVICE PAYMENTS
RECEIVED TO THE DUBLIN CITY SCHOOL DISTRICT.
WHEREAS, pursuant to Ohio Revised Code Sections 5709.40, 5709.42 and 5709.43, this
Council on June 20, 1994 passed Ordinance No. 57 -94 and amended such ordinance by its
Ordinance No. 62 -94 passed on June 27, 1994 (collectively and as amended, the TIF Ordinance)
thereby declaring improvements to parcels of certain real property located in the City (as
described and depicted in the TIF Ordinance and referred to therein as the Property) to be a public
purpose, exempting those improvements from real property taxation for a period of time,
specifying public infrastructure improvements (as described in the TIF Ordinance and referred to
therein as the Infrastructure Improvements) to be made to benefit those parcels, providing for the
making of service payments in lieu of taxes (the Service Payments) by the owner(s) thereof, and
establishing a municipal public improvement tax increment equivalent fund (the Fund) into which
those Service Payments were to be deposited; and
WHEREAS, this Council desires to specify additional public infrastructure improvements
benefiting those parcels and provide for payments to the Dublin City School District out of those
Service Payments; and
WHEREAS, notice of this amendment to the TIF Ordinance has been timely delivered to the
Dublin City School District and the Central Ohio Joint Vocational School District in accordance
with Ohio Revised Code Section 5709.83;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, Delaware,
Franklin and Union Counties, Ohio, —s6 of the elected members concurring that:
Section 1 . Section 1 of the TIF Ordinance is hereby amended to provide as follows:
"Section 1. Pursuant to and in accordance with the provisions of Ohio Revised Code
Section 5709.40, this Council hereby finds and determines that 100% of the increase in
true value of the Property subsequent to the effective date of this ordinance (which
increase in true value is hereinafter referred to as the "Improvement" as defined in Section
5709.40) is a public purpose, and all of said Improvement is hereby declared to be a
public purpose for a period of 30 years and exempt from taxation commencing on the date
of passage of this ordinance and ending on the earlier of 30 years from such date or on the
date o n w hich t he C ity c an n o t onger r equire service p ayments i n l ieu o f taxes u rider
Section 5709.40 and 5709.42 of the Revised Code, all in accordance with the
requirements of said Sections 5709.40 and 5709.42. The indicated portion of those
service payments in lieu of taxes shall be distributed to the Dublin City School District as
follows:
(i) Commencing with tax year 2003 (collection year 2004), the City shall
distribute to the Dublin City School District from the service payments in lieu of taxes
received from the Headquarters Building (located on parcel 273 -007487) amounts equal
to the amounts that School District would otherwise receive as real property tax
payments derived from the Headquarters Building Improvements absent the passage of
this Ordinance.
(ii) Commencing with the tax collection year next following the year in
which the City Director of Finance certifies in writing that the City has been fully
reimbursed out of the service payments in lieu of taxes for all costs of the Phase I and
Phase H Public Improvements including any debt service on bonds or notes issued to
finance the costs of those Public Improvements and any other costs of permanent
improvements as defined in Ohio Revised Code Section 133.15(B), Ohio, the Franklin
County Treasurer shall distribute to the Dublin City School District from those
payments in lieu of taxes provided for in Section 3 of this Ordinance, and at the same
time and in the same manner as real property tax payments, amounts equal to the
amounts that School District would otherwise receive as real property tax payments
derived from the Improvement absent the passage of this Ordinance. The remaining

monies shall be deposited into the Fund and used for the purposes set forth in Section 3
of this Ordinance.
Reference is made to that certain Tax Increment Financing and Economic Development
Agreement dated as of June 30, 1995 between The Alter Group Ltd., New Par and the
City (the Alter Agreement). Capitalized terms not otherwise defined herein have the
meanings given in the Alter Agreement. "
Se ction 2. Existing Section 1 of the TIF Ordinance is hereby repealed.
Section 3 . The public infrastructure improvements set forth in Exhibit B to the TIF Ordinance and
to be made or caused to be made by the City shall also include (i) extending and improving
Emerald Parkway east of the River to its terminus by widening, grading, draining, curbing and
paving, together with all necessary appurtenances, and acquiring real estate and interests in real
estate therefore, and (ii) acquiring real estate for parks and recreational purposes, which benefits,
or that once made will benefit, the Property (as defined in the TIF Ordinance).
Section 4 . Except as provided herein, all other provisions of the TIF Ordinance shall remain in
full force and effect and the City Manager and Director of Finance are directed to make such
arrangements as are necessary and proper for collection of the Service Payments. The City
Manager and the Director of Finance are authorized to prepare or cause to be prepared and to
submit to this Council for approval (a) any agreement between the City and the Dublin City
School District necessary to implement clause (i) of Section 1 of the TIF Ordinance as amended,
and (b)any amendments or supplements to the Alter Agreement and that certain Tax Increment
Financing and Economic Development Agreement among the City, Whitmire Distribution
Corporation and Cardinal Health, Inc. dated June 30, 1995, which amendments or supplements
may be in the form of a separate agreement, and providing for the payment of further costs of the
Public Infrastructure Improvement permitted and contemplated by this Ordinance. Those City
officials are further authorized to provide such information and to execute, certify or furnish such
other documents, and to do all of the things as are necessary for and incidental to carrying out the
provisions of this Ordinance.
Section 5 . Pursuant to Section 5709.40 of the Ohio Revised Code, the Clerk of Council is
hereby directed to deliver a copy of this Ordinance to the Director of the Department of
Development of the State of Ohio within fifteen days after its passage.
Section 6 . This Council finds and determines that all formal actions of this Council concerning
and relating to the passage of this Ordinance were taken in an open meeting of this Council and
that all deliberations of this Council that resulted in those formal actions were in meetings open to
the public in compliance with the law.
Section T This Ordinance shall be in full force and effect on the earliest date permitted bylaw.

SUMMARY:
As mentioned at the April 7, 2003 City Council meeting, Ordinance No. 44 -03 has been amended to
clarify the timing associated with the implementation of a "non- school TIF" after the terms of the
"straight TIF" expire. The implementation of a "non - school TIF" will be based on the City's
reimbursement of the Phase I and Phase II public improvements.
Section 1 has been amended to distinguish between the timing associated with the two (2) phases. The
City will be reimbursed for the Phase I improvements after the service payments for tax year 2002 have
been received in 2003. The added language identifies that the "non- school TIF" will be implemented
for the parcel associated with the Phase I improvements commencing with tax year 2003. A "red - lined"
copy of the Ordinance is also attached for reference.
RECOMMENDATION:
It is recommended the Ordinance No. 44 -03, as amended, be adopted by City Council at the second
reading on April 21, 2003.

SUMMARY:
Ordinance No. 44 -03 provides for amendments to the existing legislation that established the McKitrick
TIF District. The McKitrick TIF District was established in 1994 to provide a funding mechanism for
the construction of Emerald Parkway Phase I and Phase II, connecting Dublin Road to Coffinan Road.
The construction of the roadway was a critical component of the incentive package assembled for
Cardinal Health Inc. and Verizon, then Cellular One.
The modifications proposed by Ordinance No. 44 -03 provide for the implementation of a "non- school
TIF" after the terms of the "straight TIF" expire and the addition of Emerald Parkway from Riverside
Drive to Sawmill Road to the Description of the Public Improvements. These modifications will extend
the period of time that service payments will be received and allow the service payments that will be
received from the "non - school TIF" to be utilized for costs related to the construction of Emerald
Parkway east of Riverside Drive, including acquisition and design costs.
The construction of Emerald Parkway from Riverside Drive to Hard Road is not currently in the City's
five -year Capital Improvements Program and the portion of Emerald Parkway from Hard Road to
Sawmill Road will be development driven and may occur in the near future. Modifying the existing
legislation will allow the City to begin collecting and reserving the service payments from the "non-
school TIF" for the future construction of this roadway as identified in the City's Thorough Fare Plan.
The existing TIF is separated based on Phase I and Phase II improvements as identified in the TIF
Agreements executed in 1995. The City will be reimbursed for the Phase I improvements, the first
2,000 feet of Emerald Parkway east of Coffman Road, at the end of 2003. Ordinance No. 44 -03 will
allow the City to continue receiving service payments in 2004 based on the non - school district millage
and reserve those funds for the future project. It is currently estimated that the City will be reimbursed
for the Emerald Phase II improvements at the end of 2009.
Based on current building values and millages, the Phase I non - school TIF will generate approximately
$140,000 per year in service payments and the Phase II non - school TIF will generate approximately
$560,000 per year in service payments. Very preliminary estimates for the construction of the roadway
are $12 million. We also anticipate a future TIF district will be established for the commercial property
along the new roadway.

The modification of the TIF district and the reservation of the service payments from the non - school TIF
do not result in any obligation to initiate the construction of Emerald Parkway east of Riverside within a
certain period of time.
The required notice has been sent to the Dublin City School District and the Central Ohio Joint
Vocational School District. We have also discussed the modifications with Cardinal Health and the
owners of two Verizon Buildings.
The construction of Emerald Parkway east of Riverside Drive is an important future roadway for the
City. With Cardinal Health's potential for future expansion it will be important to begin planning for the
construction of this roadway.
RECOMMENDATION:
It is recommended that Ordinance No. 44 -03 be adopted at the public hearing scheduled for April 21,
2003.

RE: Ordinance No. 86 -08, Amending Ordinance 57 -94 as Amended by
Ordinance 62 -94 and Ordinance 44 -03 to Supplement Public
Improvements (McKitrick TIF District)
As indicated in the previous staff memo, Ordinance 86 -08 provides for amendments to the
existing legislation that established the McKitrick TIF District. At the first reading of the
legislation, a concern was expressed about the deferral of property tax for Tolles Career &
Technical Center (Tolles). Additional information was also requested on funding sources for
Tolles.
It is important to note that because of concerns that had been expressed by Tolles about TIFs in
the past, City staff met with Carl Berg, Superintendent and Steven Hull, Principal in addition to
sending Tolles the required notice required by Ohio law. During that discussion, it seemed that
Tolles was concerned about the use of the term "non- school" TIF. Because they are a school
district, they believe use of that term would not be accurate. Staff expressed the City's desire to
work with Tolles on potential alternatives when future TIF districts are established.
The following websites were utilized to obtain information: Franklin County Auditor, Ohio
Auditor of State, Dublin City Schools and Tolles. Although some limited financial information
was received from Tolles for the fiscal year ended June 30, 2008, the financial data used was
from their last audited financial statement, which was for the fiscal year ended June 30, 2007.
Tolles includes the following seven school districts:
Dublin City Schools
Fairbanks Local Schools
Hilliard City Schools
Jefferson Local Schools
Jonathan Alder Schools
London City Schools
Madison Plains Local Schools
Services provided by Tolles include instruction, support services, operation and maintenance,
student transportation and extracurricular activities. These services are primarily funded by
property tax revenues and from intergovernmental revenues, including federal and state grants
and other shared revenues.

Similar to the City, their General Fund is Tolles' most significant fund. For their fiscal year
ended June 30, 2007, their cash basis General Fund revenues totaled $8,381,784.00. Property tax
revenues are only credited to the General Fund and totaled $5,274,733.00 or approximately 63
percent of the Fund's total revenues. The property tax revenues for Tolles' fiscal year ended
June 30, 2008 increased to $7,461,374.00 or approximately 65 percent of Tolles' General Fund
revenues, due to their millage collection rate increase from .5 mills to 1.3 mills for tax year 2006,
collected and distributed in March and August of 2007.
Per Tolles' June 30, 2007 financial report, their total assessed value for tax year 2006 was
$6,434,630,942.00. The City of Dublin's total assessed value for tax year 2006 was
$1,920,898,766.00 or approximately 30 percent of Tolles' total assessed valuation. Based on
their reported General Fund tax revenue of $5,274,733.00 and the fact that the City's assessed
valuation is approximately 30 percent of Tolles' total valuation, it is estimated that 30 percent or
$1,582,420.00 of the total property tax revenue received by Tolles for fiscal year ended June 30,
2007 would have been generated by property within the City of Dublin.
Based on discussions with their Treasurer, it was learned that 55 of Tolles' total enrollment of
585 are students from the Dublin City School District. It is not known whether these students are
located within the corporate limits of Dublin; however, according to the Dublin City Schools,
59.9 percent of their high school enrollment are students who live in the City of Dublin. Using
this percentage, approximately 33 students enrolled at Tolles would be from within the Dublin
corporate limits. This is roughly 6 percent of Tolles' total enrollment.
Staff recognizes the valuable educational opportunities provided by Tolles for Dublin and the
surrounding area and will continue discussions regarding potential future partnerships. Based on
Dublin's strong property tax base, the City provides approximately 30 percent of the property tax
revenue received by Tolles while having an estimated six percent of the students.
Recommendation
Staff recommends that Ordinance 84 -08 be adopted at its second reading /public hearing on
December 8, 2008.

Parkway Phases 5 and 8 and the additional improvements identified in this Ordinance.
Service payments for Emerald Parkway Phase I converted from a "straight" TIE to a "non -
school" TIF in tax year 2003. We are currently estimating the service payments from Emerald
Parkway Phase 2 will convert to a "non- school" TIE in tax year 2009. As you are aware, other
governmental jurisdictions are impacted by the establishment of TIF districts.
In Franklin County, several agencies have operating levies. For those agencies, the McKitrick
TIF will result in the following estimated property tax deferrals:

It is important to keep in mind how these dollars compare to the overall tax revenue collected by
these agencies. The total assessed valuation for all of the City's established TIF districts is
$371.7 million, less than one and one -half percent of Franklin County's total assessed valuation.
The construction of Emerald Parkway has benefited the community and the region by providing
an alternative to traveling on I -270 and it has improved traveling in Dublin that benefits all
jurisdictions.
Washington Township has several operating levies for fire and EMS services. The total
additional revenue deferred for these levies is approximately $359,000.
The revenue from inside millage is deferred as well. Outside of the School District, the City's
impact is the highest at approximately $76,900. The property tax deferred for Tolles Career &
Technical Center is approximately $48,200.
The City's ability to continue investing in public infrastructure improvements has been a key
component of our economic success. TIFs have been a valuable tool in providing funding for
these investments. As of the end of 2007, the City has invested in excess of S79 million in
public infrastructure utilizing service payments from TIE districts to fund the improvements over
time.
A map of the City's existing TIF districts is attached, as well as the May 27, 2008 memo
addressing the proposed TIF legislation.
Recommendation
Staff recommends that Ordinance 86 -08 be adopted at the second reading/public hearing
scheduled for December 8, 2008.

Existino TIF Districts
Memo
As you are aware, the City has been able to aggressively fund public infrastructure
improvements, in part, through the use of TIFs. As part of administering and annually updating
the Capital Improvements Program the TIF districts are reviewed for their ability to fund public
infrastructure improvements.
As part of this review and discussions related to the public infrastructure improvements needed
for the Cardinal Health, Inc. (Cardinal) expansion and the City's desire to widen US 33 /SR 161
from 1 -270 to the Post Road interchange, staff plans to submit legislation to City Council in the
near future to amend the legislation that established the following TIF districts: McKitrick;
Embassy Suites; Cooker Restaurant and Lees Inn.
McKitrick TIF
The construction of Cardinal's West Campus building triggered the need for additional public
infrastructure, specifically, improvements on existing Emerald Parkway at the entrances to their
facilities, the redirection of Post Road at Commerce Parkway, and the reconfiguration of traffic
lanes at the intersection of Emerald Parkway and Post Road. See the attached letter to Cardinal
from the City.
Based on conversations with Chris Franzman from Squire, Sanders & Dempsey, the City's bond
counsel, it has been determined that for clarification purposes we need to modify the existing
legislation to specifically identify the improvements at Post Road and Commerce Parkway and
the reconfiguration of the traffic lanes as public infrastructure improvements allowable to be
funded by the TIF district.
For update purposes, the debt that was issued for Emerald Parkway — Phase 1 has been retired
and the final debt payment for Phase 2 will be made in 2016. Service payments from the
existing Cardinal building and the building currently under construction will generate sufficient
revenue to retire the annual debt service obligation remaining for Phase 2 and the current
estimated annual debt service obligations for Phase 8, Riverside Drive to just north of Bright
Road. The estimated funding needed for the Post Road /Commerce Parkway improvements will
initially be advanced from the Capital Improvements Tax Fund to the McKitrick TIF Fund as
programmed in the current CIP. The advance will be repaid in the future when sufficient service
payments are available. It is currently estimated that the advance will be repaid in 2014.

Embassy Suites, Cooker Restaurant and Lees Inn TIFs
These TIF districts were established to fund the construction of Upper Metro Place from Frantz
Road to Metro Place North. The public improvements were paid for by the developer with the
City reimbursing them as service payments are received. The developer will be reimbursed
after the first half distribution of service payments in 2009.
In an effort to improve traffic flow along US 33 /SR 161, which improves traffic flow to the parcels
in the TIF districts, the city is working to program the widening of US 33 /SR 161 from the 1 -270
interchange to the Post Road interchange. This project is not currently identified in the
Description of the Public Infrastructure Improvements supported by the TIF districts, therefore,
the legislation establishing the TIF districts will need to be modified in order to utilize the service
payments to fund this necessary improvement.
These TIF districts are currently generating approximately $300,000 per year. As part of this
year's CIP update we will be evaluating the programming of the US 33 /SR 161 widening project.
The current estimate for environmental review and design for the project is approximately $1.3
million.
Additional TIF Districts
Bridae and Hiah TIF
As we have discussed, a TIF district will be established for the Bridge and High public
improvements being completed as part of the Development Agreement with the Stonehenge
Company.
Potential Waterford Commons TIF
A concept plan was recently reviewed by the Planning and Zoning Commission for the proposed
Waterford Commons development. As you are aware, we have discussed the possibility of
establishing a TIF district for the commercial portion of this project to assist in funding identified
public infrastructure needed to support the development (i.e. traffic signal at SR 161 and
Monterey Drive). See the attached map for site location.
Potential Avery Road /Shier Rings TIF
Dublin Building Systems is currently in the process of obtaining a Conditional Use for the
development of a 44,000 square foot office complex on the south side of Shier Rings Road,
approximately 500 feet west of Avery Road. We will evaluate the opportunity of establishing a
TIF district that could be utilized to assist in the funding to improve the Avery Road /Shier Rings
Road intersection. See the attached Planning & Zoning agenda.

Based on the preliminary site and building plans received by the City for review on April 17,
Engineering offers the following items to be addressed:
Traffic /Roadway
• A study is required to determine the effect on traffic at the entry points to the site
because of the security systems will need to be performed and should describe how
the maximum queue is determined, and show this graphically on a site plan. The
placement of the security gates should not require the queue to leave the private
property. Also, this will need to be coordinated at the shared access drive with what
the adjacent property owner (currently Verizon) needs for their access and security.
• We will want all the following improvements to Emerald Parkway shown in one set
of Public Improvement drawings as they all need to be in place when the building is
granted occupancy.
• The median break at the eastern most drive will be removed and this drive
becomes restricted to right- in/right -out. The median should be restored to
match the existing median in Emerald Parkway.
• Add 100 feet to the left turn lane into the east building's main entrance.
• Installation of a traffic signal at the east building's main entrance.
• Reconfiguring the median at the west building's main drive to the new
location. The left turn storage length should be 400 feet.
• Installation of a traffic signal at the western shared driveway.
• Extend the left turn lane 100 feet at the western shared driveway.
• Reconfiguration of the southbound lanes of Emerald Parkway at Post Road to include
two left turn lanes. Also reconfiguration of the lanes on Post Road to create two
eastbound lanes. This should be coordinated with City staff to be implemented with
the redirection of Post Road and is needed when the western building is granted
occupancy.
• The western shared driveway needs to be striped with one inbound lane and three
outbound lanes (one dedicated left, one shared left and right, and one dedicated right).
Public street lighting and water appurtenances may exist at the new location of the main
entrance drive. Detail survey work should be performed so that it is known what has to be
moved.

CITY OF DUBLIN o The proposed bridge connection between the buildings may impact the existing
sanitary manhole. Elevation details of this area will need to be provided for review.
o The City passed updated code regarding encroachments to public easements last year.
An Easement Encroachment agreement will be needed to outline Cardinal's
responsibilities regarding their improvements in this easement. This agreement
requires a $300 fee. An example agreement is attached.
-► The site plan shows the on -site path system connecting to the public sidewalk at the
northeast corner of the property. Previously, it has been our understanding that Cardinal
preferred to keep their paths separate. Please review this connectivity.
The North Fork Indian Run is a FEMA- studied stream in this area. The floodway,
" floodway plus twenty" and the floodplain lines need to be shown on the plans. Any work
in this area will be incompliance with our Flood Control and Stormwater Management
regulations and will require a Special Flood Hazard Area Development Permit and
submission of a $710 fee.
The stormwater management for this project will need to meet our current Stormwater
Management and Stream Corridor Protection regulations.
The site plan shows proposed grading in the limited access right -of -way of I -270. If this is
needed, a right -of -way permit from the Ohio Department of Transportation will be required.
-+ The address for this site is currently 4875 Emerald Parkway. Please coordinate with Kristin
Yorko, PE if you desire this to change.
