AN ORDINANCE WAIVING COMPETITIVE
BIDDING REQUIREMENTS, PURSUANT TO
SECTION 8.04 ("CONTRACTING PROCEDURES"),
PARAGRAPH C. ("WAIVER OF COMPETITIVE
BIDDING"), FOR THE PROCUREMENT OF ODOR
CONTROL CHEMICALS.

WHEREAS, Section 8.04 (C) ("WAIVER OF COMPETITIVE BIDDING") of the Revised
Dublin Charter authorizes Council, by a vote of no less than five (5) members, to waive
competitive bidding requirements if it determines that such waiver is in the best interest of the
City; and,
WHEREAS, Council has determined that waiving competitive bidding requirements for the
procurement of the above referenced odor control chemicals is in the best interest of the City;
NOW, THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, ~_ of the elected members concurring:
Section 1. That competitive bidding requirements are hereby waived for the purchase of
odor control chemicals, in an amount not to exceed $60,000.00, and that such waiver is in the
best interest of the City.
Section 2. That this Ordinance shall take effect and be in force at the earliest point permitted
by law.

Re: Procurement of Odor Control Chemicals

Attached for your consideration, please find Ordinance 100-00 waiving competitive bidding
requirements for the procurement of odor control chemicals in an amount not to exceed
$60,000. (Section 8.04 c. of the Revised Dublin Charter authorizes Council by a vote of not
less than five (5) members, to waive competitive bidding requirements if it determines that
such waiver is in the best interest of the City.) This matter involves the purchase of a specific
chemical known as "Bioxide", which is a patented and proprietary odor control chemical
marketed by the U.S. Filter Company. The City intends to use this chemical agent to address
odor control problems in the "Old Dublin" area.
Since January 2000, the Division of Engineering has been researching and evaluating the use
of a variety of odor control technologies for use in the "Old Dublin" area. Based upon its
research, and the results of limited field testing, the Engineering Division has recommended
"Bioxide" as the best available technology for the type of odor control in question. ("Bioxide"
is a chemical technology, which uses naturally occurring bacteria to consume odor-causing
properties; no other chemical product or process researched by the Engineering Division makes
use of such technology.) Field testing of "Bioxide" in two specific locations in the "Old
Dublin" area has resulted in a significant reduction in hydrogen sulfide levels.
The Engineering Division has projected the annual cost of purchasing the needed quantity of
"Bioxide" for 2000 to be in the range of $60,000. A purchase in this amount would normally
require formal competitive bidding procedures; however, given the unique technology
"Bioxide" represents and that the Division of Engineering believes it is the best product
available to solve the present problem, Staff recommends that Council waive competitive
bidding requirements.
Mr. Jay Herskowitz, Assistant Director ofEngineering -Utilities will be in attendance at the
July 10, 2000 Council Meeting to answer any technical questions regarding the use of
"Bioxide" and to address specific issues regarding odor control in the "Old Dublin" area.

Re: Odor Control Chemicals
Per Council's request and at my direction, Dana McDaniel contacted Mr. John Doutt, Director of
"`~' Utilities, City of Columbus, to request that Columbus purchase the odor control chemicals for the
sewer system. Mr. Doutt stated that, per the agreement between Columbus and Dublin, Columbus
~" is responsible for design, construction, and operation of the odor control facilities as they relate to
the Upper Scioto West Branch Sewer. He confirmed that the City of Columbus is in the design
phase of this project.
Mr. Doutt said that, ultimately, following construction of the odor control facilities, Columbus
would be responsible for purchasing the odor control chemicals. However, at this time, Columbus
has no intention of purchasing odor control chemicals until the construction is complete and they
have assurance that odor can be controlled as a result of the construction of the facilities.
Mr. Doutt also expressed knowledge of other odor control issues in other sections of the Dublin-
owned sewer system. He said he does not believe Columbus is responsible for odor control in the
Dublin-owned portions. He suggested that Dublin proceed with any measures it believes necessary
to control odors in the Dublin-owned portions.
